Shrekli getting 7 years had nothing to do with his penis. Shrekli got 7 years because he had a public relations IQ of roughly Zero Kelvin and went out of his way to act like an asshole.

He didn't think through what it would look like raising Daraprim's price, especially given it was basically being given out like candy.
He didn't think through how to better deal with being subpoenaed by Congress than stonewalling their answers by pleading the fifth.

Holmes, by contrast, is classic blonde and blue-eyed, wore turtleneck to associate herself with Steve Jobs, didn't flaunt her "wealth" around as far as we know, associated with the right people -- Kissinger and, never forget, Marine General James Mattis are/were both on Theranos's board -- and carefully managed her public image for as long as she could. That's someone who's not going to get caned even if she's found out, both because of her associations and because she can more easily play into the idea she's just dumb, not evil. I grant you that having a slit instead of a stick made it easier, but I doubt Shrekli got a big whack solely because he was convex rather than concave.

Ostentation is a tricky game to play. I have a theory it works for entertainers because they know how to play characters. Shrekli was LARPing Tony Stark or Social Network Zuckerberg, and people didn't fucking like it.

I mentioned this earlier in the thread, but it's worth repeating. No one in the media is being blamed...even though they promoted her and her ideas without questioning them. The endless, mindless coverage of this woman is largely what led to her "success" and therefore, her being able to defraud people.

The media is a PR arm of big business. Movies like "The Post" lead the public to believe journalists work day and night uncovering fraud and deception.

That's not true. Most are paper pushers who reprint what PR execs write without questioning anything. Worse still, they then turn around and mock people who did question the "narrative."

Everyone who wrote about Holmes and didn't sense something amiss should be fired. The many cover stories praising her should be considered a career-ending embarrassment. Imagine having written these pieces.

I agree with whomever said that the RVF did better investigating on this than actual journalists. Maybe that why I now spend time here instead of in newsrooms.

Per today's WSJ, San Fran US Atty is still looking at criminal charges, and her settlement is just with the SEC on civil matters. So this is not the last say. However, in my experience the penalty is EXTREMELY light. WSJ basically confirms that the enire $700 million invested in the company went down the drain.

What is not being widely reported is that Medicare pulled the plug on them a while back because their device didn't work and was causing actual harm to patient health. There are 10 lawsuits pending regarding that per the WSJ.
