I thought for sure Burr was going to be a Trump supporter, but then he started talking up Crazy Bernie (no doubt due at least, in part, to his wife's influence). I stopped listening to his Monday Morning Podcasts shortly after that, so I have no idea where he currently stands. Perhaps he's always been a secret Trump supporter but knew he'd kill his career in Hollywood if he vocalized it.

Okay, correct me if I'm wrong but there seems to be a glaring misunderstanding in how sentencing works in Western nations.

AFAIK you can't be pardoned for something until you're convicted of it. So the only way Obama could pardon Hillary at this point is if they crammed everyone in a court room, said "lets get everything done today", charged her, put her on trial, got a guilty plea and optionally went straight to sentencing.

In other words, it's ridiculous. Surely you can't pardon someone for something they've been charged with. You can only pardon them for something they've been prosecuted for. And the typical time between the charges being laid and the guilty verdict is a lot longer than a month or two.

Yes? No?

No, you can be pardoned for something you have been charged with, but the acceptance of a pardon is treated as an admission of guilt. This is why people reject pardons sometimes.

If those emails have the kind of explosive material on them that we're being led to believe they do, and Obama pardons Hillary for "whatever relates to any crimes she may have committed anywhere at any time (which is what it would amount to) then you are going to see the initial shift from a cold civil war to a hot one.

How many Americans will refuse to recognise that authority, it being unjustly obtained?

At this point a Hillary Presidency is either going to be very short or you can expect martial law by the end of the first year, up to an including a blanket blackout of any anonymously posted content on the internet, right down to buyer comments on Amazon products.

Dude there are maybe a million plus Christians right now that swear that Trump is too mean to vote for, but would hold their nose and vote for Clinton just because she does not say mean things. Shit it could be a few million or much more for all we know. My own pastor cannot stand Trump's mean words and he is a old white guy that is very conservative. If he knew about this shit right now, he would vote Trump just to keep Hillary out the Whitehouse.

This shit is ultra strong. Could have been a serious game changer, but it will largely be a non-factor for too many reasons I have listed before in this thread and in the previous post.

Just knowing that they had this for so long, and held it this long, really got me bummed out right now. I won't lie. This shit is beyond cringe. What a tremendous waste!

Twitter ok, maybe not, but Facebook absolutely. So many people are on Facebook man and it was trending big time there (in fact it still is as I just checked). Plus 4 days is still a long time for this to still reach millions of people. You have to look at this thing as death by 1000 cuts for Hillary as opposed to one giant kill shot. All the wikileaks dumps, Project Veritas, her poor debates, her ill health have all slowly and methodically destroyed her chances. The final blow was last Friday with the FBI announcement. This "Spirit Cooking" is icing on a cake which has taken 4 months or so to bake.

Also notice how nothing has dropped on Trump at all this week. Nothing, nada. They're done. Obama's hysterical demeanor today with that protester, Hillary raging on that protester yesterday, Robert De Niro losing his mind and so on, these are not the actions of people who are winning. Their only hope is massive voter fraud and even that is being closely scrutinized now. As Pat Caddell said, the dam is about to burst. So get your popcorn and your surf boards as that wave is cresting into a tsunami.

I know you guys are high energy and pumped up, but this shit isn't over until the fat bitch sings.

Time is running out. Elections are not sports games where a cut and dry score at the end of the clock equates to a win. People usually don't change their votes by now and polls and stories of voter burnout are plentiful.

I guess at this point, all we can do is wait and see what happens with the FBI before the 8th. If they don't act, then Trump will just have to put down his pencil on Monday and see if what he did was enough to win. No point in furiously trying to check all his answers by then to see if they were right. If he prepared well enough and ran well enough, it will show on votes. They cannot cheat so much that it is obvious. I personally do not think there will be enough cheating to cover the field, like in 2004. I could be wrong, but I hope not.

I understand being cautious and sanguine about this election but lets look at a few things. Notice that all the polls have "tightened" dramatically, especially in blue states like Michigan, Colorado, PA. Also notice that states like NC, Ohio, Iowa and Fl are leaning Trump. All the campaigning now is going on these tighter blue states. I'm going to the Trump rally in Milwaukee on Sunday. Wisconsin. Sunday. Before the election. No one thought Wisconsin would be in play. Again, taking all of the rah rah stuff out, when you look at where the campaigns are stumping this weekend, its mostly in previously blue states. Furthermore, all of the polling models are using turnout models from 2012 and 2008. Now TK, with all of your experience in this field, do you really believe turnout will be anything remotely like those two previous elections?

I will also repeat to you that Hillary, Obama et al are not acting remotely like champions right now but instead like people who are deathly afraid of what's to come. They know the FBI is breathing down their necks. They also see how the early voting numbers are generally way down for Democrats compared to the last two election cycles. African American voters are not enthused at all for Hillary and Trump is polling better with AAs than any Republican since Nixon. Another thing being overlooked is how really pissed off people are over their Obamacare premiums that came out on Tuesday. I know my premium for my family coverage more than doubled. I'm in a position now where I'm going to have to go without insurance this year so I can keep my kids insured. I'm most certainly not alone.

There is no enthusiasm at all for her. Even the people who are going to hold their noses and vote for Hillary can't stand her. I've met a grand total of one person who actually likes Hillary. One. In her town of origin. So yes I full well understand that it's not over yet. Not by a long shot. But there are a large number of reasons to be highly optimistic here and I don't think its unreasonable to anticipate a Trump win. In fact, I believe that a landslide is in the making. But who knows maybe I'm going to wrong. I truly don't think I will be though. And this is based on reason, not emotion and wishful thinking.

Yeah the bad polls tightened up which is a good sign for sure, but even for the USC/LA Times poll using Rand, it is still closer than it needs to be. The Black vote on that poll is still ugly for Trump and I think it is wrong personally, but I think the blacks on the panel are just an unlucky batch of Hillary supporters. I'm not overly concerned with polls at this stage of the game. Early voting has already started and sometimes it is better to combine local sampling + early vote numbers if they are available in that state (some states won't release a running tally for that).

Turnout is something I am not sure I agree with the rest of the forum on. I am seeing a great deal of liberal/Democrat turnout even in my own red state. They are almost just as motivated as our side, we just don't pay them as much mind or attention. Also, the turnout I am seeing may just be older 35+ Democrats/liberals. The one thing I did notice and I agree with others on the forum, that is matching Florida's early voting numbers as well, is that the Millennials have a shitty turnout right now. I am not expecting them to do better on the 8th either.

Turnout in general could absolutely match the 2012. Maybe even exceed. I would not be surprised. Who turns out is the question. Young people voting in the Obama years was a game changer for sure, but older voters still carry the torch in any non special year. Some of those same Obama voters that were young back then are now 30 somethings that will be in a different box, so that may throw off some of the analysis. I like those post election research numbers where they grab some folks and see how they voted from 2008 to 2016, with their age, race, gender, etc. Those are extremely good reads, but useless right now.

Stay optimistic for sure, reasoning aside. We are doing well, but we must continue to observe objectively. Until Don accepts or concedes a victory or loss, we have to keep our eyes open and a clear head, for trickery and opportunities.

A standing president may pardon anyone convicted of a crime from the minute AFTER he has been sworn in, to the last day BEFORE the new president elect assumes office (the swearing in ceremony)

Many presidents like to pardon on the very last day so they do not have to talk to the press about who or why they pardoned anybody. They become a private citizen again at that point.

Usually they put all the pardons they want on their desk and wait to last moment and then sign them out. If there are lots of planned pardons, he might start signing them ahead of time.

Nov. 9th is irrelevant. Until Trump is sworn in, he can pardon whoever he wants.

Now for the other parts.

In the constitution it says a president may pardon individuals convicted of a crime. That would take a year to 3 years of court battles for Hillary and her gang to get a conviction.

Problem is that Gerald Ford started a somewhat stupid precedence of pardoning Nixon's misconduct before he could get sentenced or convicted of anything. He paid for it by having terrible approval ratings for a long time.

Also, Mr. Accuride is correct. If Hillary and gang accept the pardons, they are admitting guilt. Hillary cannot be president legally with a felony conviction and would be therefore disqualified for office.

I have no idea how that would actually work in real world because you could argue that she actually does not have a felony conviction, and I could see her trying to get the Supreme Court to jump in. She unfortunately does not know when to quit.

If they wait till the 9th to charge her, the risk is that if Obama uses an executive order to block them from arresting her, that would be a mess. Also, I have no idea what happens if a president elect can still be sworn in, if sitting in jail for a crime. That's never happened before. If she makes bail, can she still be sworn in? If so, she will pardon herself, obviously. Would Congress get upset enough to impeach and remove her? Maybe, but that would require 1 or 2 Democrat Senators to flip, unless the Republicans get a better majority (1 or 2 Rep. won't remove trust me on that)

I know one thing though. You cannot set up a re-vote just because someone committed a felony. So if the agents are arguing and fighting over this, they better ask a constitutional law expert for advice to settle their beef, because if they fuck this up, they are screwed.

Right now as of this second, arrest and charge everyone in Hillary's camp who has so much as an old parking ticket. Leave Hillary herself alone. This would effectively end her campaign but it wouldn't trigger a pardoning event.

In the time between Trump winning and taking office you would have a dozen (or a hundred?) saps to squeeze for evidence and plea bargains, which they would take because they would know Hillary was toast.

Once Trump takes office THEN bring Bill and Hillary in.

The trouble with this investigation is-and-always-has-been the sheer scope of the issue. From all accounts this criminal organisation has members and interests all over the globe. It's speculated that fully revealing all the evidence would spark a civil war and possibly a global one. If true, Hill and Bill are essentially playing a giant game of chicken with the whole damn world.
