I think the optics of suing a public broadcaster for fifty million looks terrible. This guy is in for a media skewering for a while here.

On the eve of the mayoral election in Toronto, who would have figured anyone other than Rob Ford would claim the newspaper front page?

Toronto Star looks like they are going to do all they can to destroy Ghomeshi, this is their big chance after Gawker scooped them on the Rob Ford crack story

Interestingly, the opposite can also be true.

A lack of sex can also breed "violence and evil".

A sexually frustrated man is a dangerous man.

Many serial killers, mass murderers, and terrorists are sexually frustrated.

I think we can find a healthy level of sexuality -- not too much and not too little.

Nope. Violence and evil is bred by fear.

Why would having sex (which is pleasurable and feels good) cause outward negative behaviour like "violence and evil"?

That is a extremely odd thing to say.

Ghomeshi may be screwed - not because he has done any wrong, but because the laws of consent in Canada are fucked.

Quote:The CBC has not commented. But in an article published Monday, the allegations of the four anonymous women have been set out. Acccording to the article three of the women allege that he physically assaulted them – that he “struck them with a closed fist or open hand; bit them; choked them until they almost passed out; covered their nose and mouth so that they had difficulty breathing; and that they were verbally abused during and after sex.” And that all of this was allegedly without their consent.

On the one hand, this is the classic he said/she said of sexual assault. Consent is the dividing line between sex and sexual assault, and its presence or absence is often the linchpin of sexual assault prosecutions.

But Ghomeshi-gate puts a twist on this plot, because BDSM has a more complicated relationship with the law. BDSM practices span a broad spectrum, from fantasy play, light bondage to the infliction of increasing severe physical pain. The one thing that all of the practices have in common amongst its practitioners is that it is heavily negotiated. Consent, limits and safe words are all carefully worked out in advance.

But, when it comes to BDSM – or at least its more intense versions – the law doesn’t actually care about consent. The Supreme Court has said that a person cannot consent to assault. While the cases have typically arisen in the context of bar room brawls or hockey violence, other courts have applied the same reasoning to the sexual context. So, if a sexual activity causes bodily harm, a person cannot consent to it.

Surely there has to be evidence for prosecution to go forward?

Or is it like rape now, where a woman can just accuse and a guy will be locked up with no evidence. I'm not a legal expert by any means, but I have heard of cases in various countries where it has happened.

It's already been stated in this thread that none of these women reported this alleged incidents; journalists, I mean people who type the propaganda, have extracted these accusations. How the hell can you base legal proceedings on that kind of information?

Ghomeshi's argument is that the BDSM was entirely consensual, so he's openly admitted he had relationships with BDSM elements. The problem is under Canadian law it considers all types of rough BDSM as sexual assault regardless if it was consensual or not.

I understand that, but(as I'm not familiar with legal methods) is the word of these women enough to prosecute him?

If it is, he's royally screwed, right?

Well, I mean it's his word now. Even if you completely disregard any allegations made to him, he put out his own statement on Facebook saying he did in fact engage in rough sex play. Now he honestly admitted this because any rational person would assume that rough sex is okay as long as it's consensual, but under Canadian law it does not recognize that.

I doubt it will end up in court - if it does, surely the prosecution would have to show that whatever he did to these women met the level of assault.

That would require some kind of physical evidence taken from the women at the time if it's not going to be a he said/she said battle of believability.

The case referenced in the article involved choking someone unconscious while having sex with them. Nothing reported about this situation appears to have gone that far.

his expressed public views are painfully progressive. but he worked for the cbc. the same organization that published this article the same day they fired him: http://www.cbc.ca/news/world/cbc-ideas-i...-1.2810850

one wonders if he is truly that progressive in real life.

legal experts all over ontario are chiming in that he has no chance in winning his $50 mil suit. that's not even close to what it's actually about dummies. it's about winning the pr war and embarrassing them.

I might have to re-read his Facebook post, but I don't recall him admitting to any specific BDSM acts that could be classified as assault. Surely Navigator (his PR firm) and his lawyers are well aware of what Canadian law says about criminal assault.

Also note how Rob Ford admitting to smoking crack is not actually legal evidence of a crime, even though smoking crack is illegal.

Hopefully he gets every penny and more. This is a direct attack on masculinity and male sexual preferences. Curious to hear Roosh's and MikeCF's opinion on the matter.

Judging by what happened to Hugo Schwyzer, he will either double down on proclaiming himself a feminist, or have a huge meltdown and disappear.

Reading his tweets and seeing his beliefs leaves me disgusted. I wouldn't be too sad to see him flayed in the courts by the same types of laws he's probably advocated for. At the very least it could serve as a wake up call to him.

You're not the only one who's noticed that connection. Obsidian posited the theory that the push for consent/yes-means-yes laws comes from kink culture where everything is discussed and consented on beforehand. You can't really have a spontaneous BDSM hook-up. You've gotta establish safe-words and hard limits first, or else you run into problems. Now you take that 'must consent to everything first' thinking into 'vanilla' sex and what do you get? Yes-means-yes laws where you have to ask to kiss, ask to touch, ask to fuck.

I've been away and knew you guys would have been analyzing this. My take listening to radio pieces so far have been the following:

1. Roosh should liscence Gomeshi to author "Don't Bang Canada"

2. DON'T stick your dick in crazy, especially in a country that will crucify you for just farting in a woman's general direction. He either broke this off poorly or was missed the crazy eyes to begin with and this chick was out to make him pay for rejecting him. Unfortunately he lives in a country where there are many options available to a woman for revenge.

The biggest takeaway from this I am guessing is, if you are a PUBLIC FIGURE, your PERSONAL LIFE can be screwed it wrong things LEAK OUT. Because, PUBLIC PERCEPTION is what BUILDS & SUPPORTS your LIFE.

Dangerous to depend on PUBLIC PERCEPTION.

What this guy did in his private life destroyed his public and work life.

On the other hand Kim Kardashian leveraged it in the opposite fashion.

Kinda unfair... but kind of weird and ironic how the world has become.

The point of modern propaganda isn't only to misinform or push an agenda. It is to exhaust your critical thinking, to annihilate truth.

I also agree, its like frauds like Jimmy Bakker getting their due...that being said, he banged his 21 year old church secretary...who looked like this:

vs. his wife that looked like this

anyway, back to Gomeshi. Same shit, feminist on paper but then brought down by being the kind of dude he campaigned against.

It seems like poetic justice.

I don't want to see any man catch this kind of horrible accusation, no matter how awful he is. But without suffering the results of the feminist ideas they spew forth, they'll continue to create the world that's hostile to masculinity.
