RE: How US Citizens Can Live in Europe (Schengen) Forever, Legally, Without a Visa
(03-30-2016 08:08 PM)the biggest cheetah Wrote:  I'd like to confirm that this still works. I'm planning on spending July until December (150 days) in Spain. So I fly into Poland, travel (by air, land, what?) to Spain. In December, head back to Poland and fly from there back to the Americas.

No guarantees, but the Poland loophole has worked for me. I'll be doing a border run in early May, so I'll report then.

Now, to your case, based on my experience:

The most secure way of using the loophole is to leave and enter Schengen via Poland every 90 days. So you:

1) Fly into Spain
2) On or before your 90th day in Spain, go to Poland however you want, just don't leave Schengen
3) On the 90th day of your stay in Schengen, you leave Schengen via Poland (for example, by flying from Warsaw to London, or taking a bus from Warsaw to Lviv). This resets your Schengen clock.
4) Come back into Poland
5) Go back to Spain, however you want, just don't leave Schengen
6) On the last day of your stay, or your next 90th day, whichever is earlier, again, leave Schengen via Poland
7) Fly back to the Americas (You can even transit through airports in Schengen like Frankfurt once outside of Schengen, because these airports have non-Schengen connecting areas)

Based on what I've read in this thread though, I've heard Spain doesn't care if you overstay Schengen, or they also have a loophole similar to Poland. If that's true, you have two more options:

1) Easiest but riskiest - Fly into Spain, stay as long as you want, and fly back to the Americas

2) Less easy but less risky - Fly into Spain, leave Schengen via Spain to reset your clock on the 90th day (for example, fly to London), come back, stay some more, then fly back to the Americas on or before your next 90th day

Also, as I understand, at least with Poland, you can also simply leave Poland every 90 days (by, say, going to Germany), and, as long as you have proof you left Poland on or before your 90th days (like hotel receipts), you should be fine leaving Schengen via Poland. I believe Roosh has done this. That may be the case for Spain too (ie, go to France every 90 days or less, and get hotel receipts).

Finally, read this entire thread before asking any more questions, if you haven't already. Also, do a Google search, since there are other forums that cover this.

RE: How US Citizens Can Live in Europe (Schengen) Forever, Legally, Without a Visa
Thanks 262. I did read the thread fully, and I'm active in the travel blog community, so this thread was quite a surprise to me since I haven't seen this loophole mentioned elsewhere. I was planning on getting a student visa, but that can be expensive and time consuming.

As far as option 1 goes, it makes me slightly nervous to overstay in Spain. I have friends teaching English there, and they've had both good and bad experiences with overstaying or with going to Morocco or somewhere outside Spain and coming right back in. I'd prefer not to put my fate in the hands of a random border agent if it can be avoided.

My ancestry is actually Polish, so I'd enjoy having a chance to go visit. Thanks for clarifying that I should fly into Spain and then leave via Poland, I understand the loophole better now.

Please do let us know how you fare in May, and I'll add in my own experience later this year.

RE: How US Citizens Can Live in Europe (Schengen) Forever, Legally, Without a Visa
Anyone crossed into Germany using this loophole, since they instituted "border controls" (apparently on September 13, 2015 - https://en.wikipedia.org/wiki/Schengen_A...r_controls )?

Reason I ask is I'm planning to go there on Tuesday from Poland by bus.

My guess is the checks (if any) are similar to those the French are doing - basically screening for security and migrants, and not visas: /thread-31412...pid1176862

Edit: Re-read this thread. Looks like it'll be the same as the French, if anything: /thread-31412...pid1206176

^ Reporting on taking a bus from Poznan to Berlin yesterday. No issues, since the border there is completely open. Not even a traffic stop.

Edit: I didn't see a traffic stop in the other direction either.

^ No issues coming back from Berlin via Poznan late yesterday evening.

Between Berlin and Frankfurt an der Oder, my PolskiBus did stop for a German police ID check. Good thing I had my passport.

They didn't care about my Schengen entry and exit stamps.

Just finished a border run via Hrebenne, as I mentioned in a previous run. Difference here is I did it during the day.

Once again, no hassles at all from Polish or Ukrainian border control there. I definitely prefer that part of it over Gdansk airport.

Crossed another border within Schengen with no issues, this time going from Poland (Kudowa-Zdroj) to the Czech Republic (Nachod) by PolskiBus. Not even a security check.

I am starting to think 262 is some sort of KGB agent or MI-5.

I don't think the KGB exists anymore but you get my drift.

Edit: Through my connections found a pic of 262 with his handler.

Just finished another Hrebenne border run as I've done before.

On coming back to Poland, the Polish officer did ask me where I was going, so I said Poland, even though I already booked travel within Schengen to other countries.

No other questions or issues.

Overstayed my 90 days Schengen by 1 day in Budapest.

During outgoing passport control no one said a word.

RE: How US Citizens Can Live in Europe (Schengen) Forever, Legally, Without a Visa
First of all, I discovered this forum by searching this issue on Google. That's how I came across. I've been reading the whole forum ever since and it's perfectly fits my lifestyle.

This is what I found because I was in Latvia recently

http://www.mfa.gov.lv/en/consular-inform...-agremeent

Americans have extra 90 days in Latvia, additionally to that 90 days in Schengen but it's little tricky. It doesn't let you re-enter the country once you used your 90 days.

Let's say: you've been to France for France for 88 days. Technically, you can only stay 2 days in Schengen zone but if you go to Latvia you can stay 2 days + 90 extra days (If you exit from Latvia, of course.)

So, what I did was, I went to France for 88 days, came back to New York.

Went to Riga, got in, went to France again and came back to Riga and exited the Schengen from Riga. So I stayed around 178 days.

I used my 90 days in Europe by August.

But I just landed in Copenhagen 2 weeks ago with no problem. Americans get to stay 90 days in Denmark and Sweden regardless of if they stayed in Schengen area 90 days prior.

Just finished another Hrebenne border run as I've done before.

On coming back to Poland, the Polish officer did ask me what I was doing, so I said visiting.

Also note that using the bathrooms on the Polish side now costs 2 PLN, exact change only. I don't think there are bathrooms on the Ukrainian side, since I've never seen any passenger go inside - plus the locals paid the 2 PLN on the Polish side.

No other questions or issues.

Yo, probably a long shot.

Anyone ever been rejected a VISA in an EU country and had to pay the consequence by leaving the Sch Zone? I know someone expecting this and want to know what to tell her.
Border run?
Permanent return back to home country?

Is she in schengen already? Was she rejected by a schengen member? What kind of visa is it that it was Rejected by an individual country of the schengen?

Yes she's been in Schengan for 2.5 years but has been on a long term visa with the country she's in. I read somewhere your Schengan time resets if you're granted a long term visa but am assuming the consequence of the rejection depends on the individual country.

I overstayed my visa by about(or at least) a month at the moment and currently in poland.
Not sure if it'd be worth it to try and do a border run or just say fuck it and stay inside schengen indefinitely
I was planning on exiting out to ukraine anyway, but i would definitely like to not be banned from schengen

I recently flew into Amsterdam with 15 days on my schenfen visa. They checked and accidentally miscounted, almost telling me that I needed to fly back to London. Immigration officer said they sent someone back earlier that day who had too few days left.

Surprised this site isn't mentioned - it's the Polish Embassy in the DC: http://www.waszyngton.msz.gov.pl/en/wasz..._en_visas/
Quote:Based on an exchange of diplomatic notes between Poland and the USA, since April 15th, 1991 the US citizens are allowed to enter Poland for any 90 days period without visa. The common rule 90 days of stay in 180-day period does not apply in this case. Please note that the common rule is applicable for other Schengen States, and if its a consecutive trip to Poland you must cross the Polish border directly from the third country (non-Schengen State) e.g. direct flights from Chicago, New York, London, Moscow, Kiev etc. Longer stays require Polish National Visa, provide by the Polish Consulates in the USA, or a temporary residence permit, a petition shall be filed in Poland in an appropriate Voivodship Office (Urząd Wojewódzki).

Edit: I'm using the ChangeDetection.com monitoring service to have any changes to this page e-mailed to me. Recommend similar to any other guys using these diplomatic notes.

She's probably going to pay big fine 6200 Euro and 2-3 years ban from Schengen. Thats what happened to my friend's sister. She stayed 2 years in Paris.

I'd suggest moving this thread to the private forum. It might attract too much attention, bringing unwanted attention, and the party might get shut down.

I know for a fact that many "fresa" Mexicans scour in the interwebs looking for ways to stay in Schengen indefinitely. A couple of them have asked me for any tips, but as I dislike fresas....I have no incentive to help.
