Jeff Flake and John McCain (Republicans in name only) could be very, very dangerous for Trump's appointment plans.

If they both abstain, the VP could break the 49-49 tie. If they both vote against, it's a rejection of the appointment.

It's concerning for sure. McCain in particular seems to want to spend his dying breath lashing out at Trump.

The example you cite was itself a legislative proposal. It says so in that Wikipedia article you linked.

What Trump could "probably" do is dependent on existing statutory language regarding the federal courts, and on the prospect of changing it through Congress.

They have to have probable cause to investigate her to begin with, otherwise that is a violation of the 4th Amendment. No DOJ (especially today's) is going to bother looking at her, unless they get a referral of some sort. At that point of the matter, that is on congress to address not Trump. The president has no powers to affect any standing judge, period. Once they are sworn in, that is it. Done. Till death. Only congress can remove them, then the president appoint a new candidate. That's it.

Court packing is a throwback to a different time. It likely would not be tolerated in America today. Trump has enough problems, this would make stuff 100 times worse. This was one of the downsides of FDR and how they passed an amendment to limit presidential terms to 2, like George Washington recommended, because he went too far. My personal view, if Trump tried that, an amendment would likely get bipartisan support and be very swift. Just because an exploit hole is still present, does not mean it is wise to use it.

Actually, someone will replace him. But with the passage of time, it looks increasingly likely that the Republican governor of Arizona can appoint a replacement rather than open his seat up to a special election.

McCain has terminal brain cancer. No one expects him to finish his term. The fear was that if he resigned before the primary at the end of August a communist might take his seat. Many expected him to step down on July 4. There was speculation that the Governor would appoint his wife to replace him.

Unrelated to McCain, there is a good editorial in the WSJ today about the court. If you don’t know what a penumbra is in the context of the Supreme Court then you should read this, it’s a term you will hear often in connection with the confirmation of Kennedy’s replacement because a penumbra is the shaky foundation for much of left wing “rights” in this country. The left knows the foundation is invisible and that is why Kennedy’s replacement heralds a sea change

He isn't going to step down. They would have to drag his carcass out of the capitol. Anyone that knows anything about John knows how obstinate he is. Stubborn does not even begin to describe how he is as a person. He also has Trump Derangement Syndrome.

I think our best bet is November. They can stall the court appointee all they want with process blocking and filibusters of votes that precede hearings on judicial nominees all they want. After November it will not work.

Even McCain I think won't block someone like Kavanaugh. Official Republican people like him (NR endorsement). Ann Coulter likes him too so I'm giving a pass on the former.

Plus as I mentioned in the other thread Barrett has 2 adopted Haitian kids. She could be a wild card on immigration issues.

Well don't let your guard down yet. There are two more possible judges that could be filled later on, so we could still see one of them.

What I do not want to see is like for like replacements. Such as, a guy steps down, a guy put in, a woman steps down, another woman put in her place. Fuck all that. Put the right man in, regardless. If Clarence steps down, don't go find whatever black man you can find like some bullshit affirmative action hire. If you know anything about Clarence, he would hate Trump to death for doing that.

If one of those women steps down, the press is going to furiously rage out and howl to death for another liberal woman. Many will settle for and hold their breath for a conservative in lambskin woman. Trump should put another man in there white or not, and refuse to budge even an inch on that.

A court stacked with men will go a long way towards key issues not subverting the country deeper than it already has.

You may be right but yours is not a mainstream view. Major outlets wrote articles expecting him to step down on July 4. The importance of Kennedy’s replacement to Trumps legacy, and McCains animosity towards Trump and conservative values, might have affected his expected decision to step down

I did not see any news articles on this before or today when I saw your post and did a quick google check. If you have some proof of his failing health provide a link.

If he was intending to resign, he would very likely hold a presser and make a formal statement with the date he would be stepping down. He is not really the surprise type of person. He's 80. In some ways that is one of the ways we can easily track or monitor him. He's fairly consistent in his behavior by now.

If he had to suddenly step down, it means his health is extremely bad, even for him.

Average life expectancy of someone with his type of brain tumor: 12-15 months. Ted Kennedy, who died of the exact same type of tumor, lasted 15 months.

McCain diagnosed July 2017. And he's 80, so i'm going to assume he can't be expected to materially beat the averages. He'll be dead by the fall. Sorry if that seems cold. It's based n the medical situation, not what i'd like to see.

He was diagnosed in July 2017. People with this type of cancer usually have 12-15 months from when they were diagnosed. Assume he croaks in 3 months, give or take.
