The End: Theranos CEO Elizabeth Holmes Banned For 2 Years From Entering A Lab

Last night on the company website Theranos notified investors that it "received notice from the Centers for Medicare & Medicaid Services regarding the imposition of sanctions arising from the 2015 survey of its Newark California laboratory."
The sanction Theranos lists from the CMS are as follows:

–Suspension of the laboratory’s approval to receive Medicare and Medicaid payments for any services performed for the specialty of hematology
–Cancellation of the laboratory’s approval to receive Medicare and Medicaid payments for all laboratory services
Not much of a shock considering the once over-valued but always full-of-lies startup blood testing company had recently voided years of lab results because all tests using proprietary technology were bullshit.
What we've said previously on the matter:

Further, Holmes' new 2 year ban comes on the heels of not only her firm's lack of due diligence during a period when the firm garnered a ridiculous $9 billion valuation, but also on the heels of a fawning media and drooling celebrity base that included the Clintons.
And now for risking roughly 900K lives each year on a bonk premise of real testing even though all tests were garbage, Ms. Wanna-Be-Steve-Jobs will be banned from entering a lab for 2 years.

While the revocation would not take effect for 60 days, the company will not conduct any patient testing in the Newark lab until further notice.
During this period, the company will continue to work with CMS to resolve and remediate outstanding issues in the Newark lab, and will continue to provide services to its customers through its Arizona lab.

Only part of our concern should be that she deceived the public. The other part should be that the media bought her story, didn't do any questioning or research, and made her a star.
Besides the countless articles written about her, she made the cover of four major business magazines (below). So far, none of her media cheerleaders have issued apologies as far as I know. Nor have there been any resignations from reporters who wrote those glowing cover stories.
My guess is that her story -- which was cooked up by public relations experts -- fit the media's narrative too well for them to want to question it. It's sort of like the UVA "rape" case. It was so good they had to write it up, even if it wasn't real.
If the media can bungle a story this bad, what else are they mis-reporting to us? What else have they gotten completely wrong?
Back in 1967, only one rock music writer gave a negative review to the Beatles Sgt. Pepper album: Richard Goldstein of the Village Voice. Goldstein spent more time explaining himself and issuing "mea culpas" to his critics than any writer of these cover stories did. And all he did was write a record review.

What a total crock of shit. What kind of punishment is that for this kind of outrageous, calculated fraud? Even more galling because this woman doesn't even work in a fucking lab! She's not a scientist, she's an executive (or more accurately, a professional bullshitter and con artist) and was engaged in executive-level activities (wooing investors, attending board meetings, making media appearances, etc...). This "punishment" would be akin to a professional baseball player getting a two year suspension from the PGA tour after being caught juicing. What the fuck?
Honestly, I think this situation is just too embarrassing for way too many people. They want to simply flush Theranos down the memory hole as quickly as possible and forget it ever happened. There are so many journalists and investors sitting around with egg on their faces after this fraud came to light. To make an example of her by prosecuting her only serves to highlight how egregiously these "experts" fucked up.
But in sum, I still think this is one of the most hilarious stories in years. I can't get over the sheer chutzpah of this woman. The Steve Jobs turtlenecks get me every time. That was literally all she had going for her: bullshit and a black turtleneck. And look how many people fell for it. I laugh every time I think about it.

You just know if it were a guy CEO fucking up like this, his face would be all over the covers of publications, electronic and in print, regardless of the level of media embarrassment at their own lack of due diligence.
What's more is she will more than likely reappear in some other arena, elevated again by her fawning connections in DC and Silicon Valley. No guy would ever get a second chance like she is about to get. Stay tuned for the allegations of misogyny that pushed her over the edge, intimidation by male billionaire investors, etc. etc. Just wait, it's still being processed.
As for what else they can do in terms of punishment, it looks mostly civil right now. If any customer can prove they were harmed by the bullshit tests conducted by Theranos, that's a major lawsuit waiting to happen. There's also the matter of whatever disclosure did not happen as per contractual agreements along the way - I'm sure every vendor she's ever dealt with is looking into potential lawsuits and/or termination of contracts based on breach. If she lied somewhere in the process for a loan, stock offering or other financial arrangement that could lead to criminal prosecution, but since the company never actually went public and all the funding looks private, there may not have been any laws broken.
It also doesn't look like she was stupid enough to lie to federal investigators or she would have been charged with that by now. The minute the consequences of continuing the scam got serious, she backed down.
