Legislation that redefines rape as sex without consent came into effect in Ukraine on Jan. 11. The punishment for the crime remains unchanged: three to five years in jail.

Previously, Ukrainian legislation defined rape as sex by force, by threat, or one where perpetrator used the victim’s helpless state. Under the new legislation, seen as more progressive, consent to sex must be given.

The law specifies that consent must be “given by a person out of free will” and adds that “circumstances must be taken into account.”

The same legislation also introduces an increased punishment of five to 10 years for non-consensual sex when the victim and perpetrator are spouses, ex-spouses, or when they are or used to be in any close relationship.

The legislation enforces the Council of Europe’s Convention on preventing and combating violence against women and domestic violence. The law was approved by parliament and signed by President Petro Poroshenko in December 2017, but only came in force a year later.

As of April 2018, only eight countries in Europe recognized sex without consent as a crime, according to Amnesty International, including the United Kingdom, Ireland, Germany, Cyprus, and Sweden. In Europe, mobile apps allowing partners to give consent before sex have been launched.

The expectation is that the new legislation may prompt the victims to report sex crimes more often. Today, rape often remains unreported in Ukraine, according to activists. in 2018, fewer than 2,000 rapes were reported in Ukraine, where at least 42 million people live. It means the rape rate in Ukraine is approximately five per 100,000 people, which is considerably lower than in other European countries, where it can get up to 50 per 100,000 people, according to Eurostat.

The same piece of legislation also criminalizes domestic violence in Ukraine.

Domestic violence is defined as “systematic physical, psychological or economic violence against a spouse, a former spouse, or another person that the perpetrator is or used to be in a family-like or close relationship that leads to physical or psychological suffering, harms the victim’s health, causes disability, emotional dependence, or impairs the quality of life of the victim.”

Domestic violence can be punished by two years in jail, but the law also envisions an option of community works as punishment.

I’m confused. Sex without consent was not already considered rape?

Is this one of those deals where you have to get affirmative consent in writing at every stage of the interaction now and a girl can retroactively withdraw consent after an interaction that she consented to at the time has already occurred?

They doubled the penalty specifically for people who are spouses or have some other close relationship. What is the reason for this?

Also, was beating up your wife not a crime before either? What do they mean when they say that they criminalized “domestic violence?”

And what is “economic violence?” Is that just a man not giving his wife the amount of spending money she asked for or being unable to afford his alimony payments?

Given that it's not a very PC country this will most likely only directly benefit the political class though to #metoo some poweful guys and purge them and give less savory girls some leeway over foreign PUA types and foreign sponsors that don't play ball anymore. Leaving for greener pastures has become pretty much impossible 5 years ago or so. Everywhere is crap now and while you don't have the intense hostility as in western countries in low income places with huge wealth disparity, there is no easy way out anymore. Blame smartphones and easy access to high status / high income guys globally.

Lowered western incomes don't help it either.

I don't think this will have a big impact. As semibaron says , noone cares about the law in Ukraine. It s just a piece of paper. Unfortunately the country is incredibly corrupt. Who has money will make the law the way he wants , should it be for small or big people.
Nevertheless Ukraine with a strong dictator and moral ruler could turn into one of the best country in the world.

Economic violence: If the man spends household money without consulting the woman.
Also economic violence: If the man questions the woman about the way she spends household money.

2) Diluting the term "violence" into meaninglessness

Don't think that Russia is some untainted paradise. Look at the sheer amount of flights between Moscow and various Western European major cities, and even the US (NYC, LA, Miami). A huge percentage of the passengers on these flights are Russian girls getting "tainted" by the West.

Or look at the sheer amount of Russian girls in Thailand, who participate in the same beach debauchery scenes that the Western girls do.

The big difference with Russia, compared to Ukraine for example, is that there is outflow, but not much inflow. Russia has very few sex tourists unlike Ukraine, and the country is huge. So if you want to be the only Westerner in the disco then you can fill your boots if you so desire
