I would just let it go mate. An ex of mine broke my Tissot watch and my entire cologne collection. I'd put the entire value of all of that at around 1k. I thought about lawyering up but then just moved on. The energy you'll spend in addition to the stress will age you and cause God knows what sorts of health problems.

I have seen a few judge Judy episodes and a few cases she presided over dealt with this dilemma. She states basically the ring has an attached condition that you marry. Otherwise you should give it back.

For principal go to court. It will also inconvenience her too. So she may just say fuck it and give it back.

Well with that being said, I'll stay give you some advice. Generally the Smalls Claims limit is $5,000 for personal claims, but that can change based on state.

Your problem is that the small claims judges/magistrates base their rulings on their feels or opinions. Yes, they are supposed to rule based on black letter law, but more often than not its easier and faster for small claims court to rule on the case as they saw it in court and the impressions they received from the parties. There are no legal briefs backed by sound arguments in small claims, so it can really turn in to a toss up.

They get away with this because there are no lawyers to object and question their rulings. So if you go before a small claims judge (who is most definitely not a trial judge, more of a traffic court judge), you're at the mercy of how he or she feels about you, your situation, or how many cases they saw before you, or how hungry and tired they are. So it's a toss up whether you'll win or not.

Finally, lets say you do win and get a judgment against your fiancee. Well your second hurdle is collecting any of it. Once you get a judgment you can file it with a court. But that doesn't mean she'll pay. After a period of time, you can pay for the Sheriff's department to collect and they will place a lien on personal accounts. But that doesn't mean anything. The minute she realizes there's a lien on her account she won't use it. She will use a family members account, or have her sister or something open a new one for her in the sister's name. You could place a lien on property like a house, but if she doesn't own property then there's nothing to lien. You basically could go years without collecting more than $500 on the $6k judgment.

So basically it isn't worth your time, unless you're just trying to get back at her. But even then I don't think it would be worth it to use this as some type of revenge.

Who are these ‘people’ chomping at the bit to take you to the cleaners? How do they even know whether you’re getting the ring back or not? And it’s none of their business, nor should they even care.

So you are pursuing this through the legal system, despite a very low chance you’ll get the ring or the money back (for reasons Dodgy outlined), just to make a point? And again, to whom?

If it’s just her, you’re just doing this for revenge and claiming that you’re doing it out of principle. I’m not saying you’re wrong to do this. You want to pursue this, go ahead. But just be honest with yourself about why.

Guys i didn’t want to bring this up initially but since a poster brought up my wealth...

1) her entire family is obviously after $$, won’t go into details but you can use ur imagination

2) anyone who knows my real name can google me and know I’m legit (pm me for proof) and anyone can do a quick legal search and see all my legal actions. This is my first small claims case but I’ve never lost a case in court. Any lawyer her family hires will see this and refuse the case unless she has something bulletproof. She doesn’t I’m very careful

3) fact of the matter is if someone knows ur rich and ur life details they will go after ur money unless you show u are willing to hit back 10x as hard. I’m not trump but same shit applies. @cleanslate you underestimate the number of con men and con women out there. It’s as simple as finding a property I own and waiting around for an accident. Or following my car and trying to get me to hit them. All sorts of crazy shit. And I don’t even have as much as those people think I do based on google search but still happens at least few times a year. Sometimes I wish I could delete myself off google

Well it seems that you should be thankful that she left you because you likely dodged a bullet with her and her family. But again, small claims is a different animal than civil court and there are no lawyers involved. And if you're trying to hit back at her or fuck with her, small claims isn't the place to do it. There is no time or money commitment on her end like there is in civil court. She can ignore the process server, ignore the court date and then ignore notice of the judgment.

In fact, like I said in my previous post small claims is the worst place for you, because if you show up to the court date suited up with rich guy swag/confidence and she shows up playing the poor helpless victim describing how cruel you were to her during your engagement, then you'll be in a tough spot.

Yeah - sometimes men are giving off family-heirlooms worth 100.000$. I read about those lawsuits. Women sometimes try to keep it, but the court usually sides with the man since it is a specific conditional gift.

Post-marriage - even if she dumps you 1 minute after she signs on the dotted line - that is a completely different matter.

Having a lien on your person even if you are a sub-average shmuck is still a very bad thing. it'll handicap you like crap. worth more than the ring itself if the guy is for it not for the ring itself.

It should be easy to get a judgment in small claims court but that may not be necessary.

It is possible that once she gets the notice that a small claims case has been filed that she would just return the ring.

Most states have a section on the court web site that explains the process; basically fill out the small claims form for the filing (your name and address, her name and address and then a section were you explain what your damages are and everything about the case) and mail it in.

Oh I'm quite glad she left. I can't do civil court the amount is too small. I have every text conversation and google hangout we've ever (including me being very reasonable after arguments) she will have a hard time proving I was cruel. I get it though I'm not going to be custom suited down or anything.

I don't think you can just ignore all that legal stuff. You can always garnish wages. May take time to collect but there are consequences.

Anyway, it's not like it's taking up a ton of my time there is just one court date. it's not like a civil case where there is trial after trial. The risk/reward is decent and I think of it as a pre-emptive strike so her family doesn't fuck with me later.

What you don't understand is this is a financial shit test. Who the fuck keeps an engagement ring? It makes no sense. If I back down and don't do anything she will probably try to take me to civil court on something made up just because she thinks I'll settle.
