Haven't heard the current status of this, but two female members of congress are pushing for "anti-stealting" laws. Another thread covered this but it bears repeating - watch this space to see what set-asides they try to create for homosexuals and women who poke holes in condoms. I fail to see how taking a condom off mid-sex without your partner's knowledge is in anyway worse or even remotely equal to knowingly spreading HIV to your partner (which apparently is legal under CA law)

Last year there was an attempt to introduce a law that would extend the nightlife hours of bars in CA to 4 am, like on the east coast. It was shot down due to concerns about 'safety'. This was about a month or so before this law about HIV infection was passed. Go figger.

I actually retract my previous statement as after a discussion with my girl it makes more sense:

Using protection is a choice. A person having HIV doesn't particularly matter as long as you are using condoms which is the only effective method of preventing STD transferral. That said, use of protection is a choice and if you choose to have sex with someone without protection then you are agree to incur all the risks associated with that (possible STD contraction and possible pregnancy). Now, if a woman agrees to have sex with a man on the grounds that a condom is used then it is pretty fucked up for the dude to pull the jimmy off mid-bang then go in raw.

What I'm saying is if you knowingly fuck raw then there are going to be risks. The person you're fucking could even have AIDS for all you know and they very well may not tell you about it (or they don't know). Now if you choose to be safer and only fuck when a condom is used, then having a partner remove the condom during sex makes it a more sinister act - again imagine the partner has AIDS and is now exposing the other to the disease that they did not agree to be exposed to.

I get that.

Still don't agree that knowingly sharing HIV is only a misdemeanor. I don't see how purposely giving someone an incurable terminal illness is not basically murder.
