I'm not so sure about that.
Lawsuits related to hiring and discrimination are particularly thorny and very expensive, especially for a small company.
You're spot on that any lawsuit can really hurt a business, with or without legal merit.
But let's take the two questions and how I would personally answer them which I think shows how they have nothing to do with either religion or race:
1: "What does faith mean to you?"
A: "I don't have pure faith in anything. I don't believe anything is 100%. I would like to think the sun will rise tomorrow, but I don't know it to be true. I would rather discuss the word 'Loyalty' and what that means to me."
2: "What does 'privilege' mean to you?"
A: "It means that some people are born lucky. Their fathers are rich, they go to nice schools, and they grow up flying around the world on jets. Then some unlucky bloke is born with cerebral palsy living in an awful neighborhood. That leaves the rest of us majority of regular people that can either decide to bust our asses and work our way up the foodchain or we can choose to slough off and whine. I promise to do my very best for you."
I don't know if those answers would get me hired, but they're honest replies that first popped into my head. And neither had anything to do with race or religion.

That's how you would answer it, but imagine this scenario.
"What does faith mean to you?"
"Faith is important to me. I was raised in a strict Muslim family and we prayed five times a day...blah blah blah."
Not hired....lawsuit alleging s/he was not hired because she is Muslim, even though the real reason was simply there was a better qualified applicant.
