I don't get why this has been made about black vs white.

The male has always received the short end of the stick in these situations, there's been many other instances of this with teens where the boy gets charged more harshly and the girl sometimes faces no punishment.

The way this story is presented is too race-baity for my tastes, and far below the standards of Reason. The fact that the author prefaced a crucial point which gives an explanation to the difference in charges with "For what it's worth", like it's a minor detail that should not sway you from the picture he has tried to paint, betrays the angle he desperately wants to sell.

There is no evidence race has played a factor. It's simply the statutes dictating charges based on age.

All that aside, these cases where kids are being charged with sex crimes for sexting with their bf/gf are, indeed, absurd.

Honestly I think that if the case were a white girl and a white boy then the boy would get a lighter sentence. I don’t want to believe that but when it comes to reality I’ve come to the point where I have to begrudgingly accept it.

Try as we/they like to make almost everything officiall on paper, it is practically never enforced, unofficially, or it is but with halfhearted measures or subjective criteria.

But unofficial equality, such as the case between good bros and fellow comrades, it’s also officially enforced. With no paper needed.

It’s a paradox. I don’t like it. But it seems to hold true as I walk through life and different situations.

A peculiarity I noticed growing up poor in one of the wealthist and whitest towns on the East Coast - white parents and school administrators seemed to be unable to resolve the cognitive dissonance generated when irrefutable evidence was presented that for all the thousands of hours of extracurricular activities, SAT prep courses, "gifted and talented" special treatment, scheduled social activities, and in general, millions of dollars of both private and taxpayer money thrown at these special snowflakes...their daughters still turned out to be sluts, and their sons still turned out to be drunks, drug addicts, and bullies.

Only one solution. Blame the victim, and kill the messengers.

There hasn't been any sentencing yet, or trial. Just charges. As I noted in an edit to my post, the reason for the difference in charges is simply due to age.

There surely are instances when other factors come into play, but in this instance the law is being followed and the disparity is mandated by statute.

Teenagers are sexually interested in each other? No way!

First of all it's ridiculous to charge anyone with a crime here. Teenagers are horny, and they're going to tease, and they're going to entice and they're going to fuck.

Like Phoenix said above, this is a victimless "crime". This is simply the state enforcing how it wants people to communicate. Now what if it were 8 year olds sexting each other? I don't think the government should start prosecuting them but it certainly should be stopped.


Secondly, I think GlobalMan is right. In comparison to some of the other fucked up stories of charging kids with sex crimes, this isn't at all different.

If this blows up in the media, I see it as another way to incite racial tensions. Some whites are going to be pissed and some blacks are going to be pissed and we're all going to blame each other and pretend that race mixing has never happened before, and that whites are the only ones that would frown upon it.

Hell, you can even picture this on the news as a little segment with some white guy desperately trying to convince everyone that he's not racist and a mexican woman saying that the police response to this is further evidence of systematic oppression, and that we've still got a long way to go. I guess BLM isn't agitating enough and we need these people to start fighting each other in the streets.

So instead of criminalizing behaviour on smartphones that teenagers certainly practice in private, how about getting the state out of our fucking lives?

It's common knowledge at that age what child porn is and being underage sending nudes came mean if you get caught.
This clearly isn't a child pedo gang exploiting and abusing kids, so why apply such harsh penalties to these kids?
Just give them probation and take a workshop about child porn and exploiting children or something.

I'm curious how exactly the sexting was discovered. Was it a parent or school teacher that found the pictures and video.

Nope, these kids are just normal. The state is dumb. No actual natural law crime took place. This is just another case of a shittily written law being strictly applied for the sake of it. Not every naked picture of an under-18yo is automatically evil -- that's such blunt-minded thinking. You can't 'sexually exploit' yourself. There are definitely some oddities with these type of laws.

In some states a teen can be within the legal age of consent but still charged with a crime if they send inappropriate photos.

In Louisiana the age of consent is 17 with an age difference of two years; so if the two of them had actually f-d it wouldn't have even been illegal as far as I can tell; yet merely sending a nude pic results in a felony - go figure.

Once you cross a certain age threshold, having any type of sexually based contact outside of the age of consent law gets you charged.

We all live by these rules, apparently unless of course you happen to be of a different race and want to throw race agitation politics into the mix in either an attempt to get yourself off by manipulating politics or, for some reason, want to start a race agitation thread here.

Unfortunately, there is no justification for softening these laws based on any single case. If this line softens, and the next line is the hard line, then what about the next case that challenges that line? The hard line has to exist somewhere. It existed where these two people met and it was crossed. Case closed. The White girl got the misdemeanor because she wasn't guilty of the more egregious violation.

Laws designed to put away the worst adult offenders who actually prey on and do despicable things to young children are being applied to teens being teens and people just shrug their shoulders with indifference.
