New York Woman Sues 12-year-old Nephew Over Hug That Broke Her Wrist

Jennifer Connell claims the boy, Sean Tarala of Westport, acted unreasonable when he leaped into her arms, causing her to fall on the ground and break her wrist four years ago. This week Connell is asking a six-member Superior Court jury to find the boy liable for his actions.
She is seeking $127,000 from the boy, who she described as always being “very loving, sensitive,” toward her. The boy is the only defendant in the case.
In court Friday, the boy, now 12 years old, appeared confused as he sat with his father, Michael Tarala, in the Main Street courtroom. The boy’s mother, Lisa Tarala, died last year.
On the witness stand before Judge Edward Stodolink, the 54-year-old Connell, a human resources manager in Manhattan, testified she loves Sean but believes he should be held accountable for her injury.
On March 18, 2011, Connell, who has no children of her own, arrived at the Tarala home at 25 Woods Grove Road to attend Sean’s birthday party.
The boy had gotten his first two-wheeler for his birthday, and was joyfully riding the bright-red bike around and around the home, according to testimony.
But when he spotted Connell, he dropped the new bicycle on the ground, exclaiming, “Auntie Jen, Auntie Jen.”
“All of a sudden he was there in the air, I had to catch him and we tumbled onto the ground,” Connell testified of her encounter with the 50-pound boy. “I remember him shouting, ‘Auntie Jen I love you,’ and there he was flying at me.”
Although hurt, Connell said, she didn’t complain to the boy at the time.
“It was his birthday party and I didn’t want to upset him,” she told the jury.
But, Connell continued, her life was turned upside down as a result of the injury.
“I live in Manhattan in a third-floor walk-up so it has been very difficult,” she said. “And we all know how crowded it is in Manhattan.”
And then there is the damage the injury has done to Connell’s social life.
“I was at a party recently, and it was difficult to hold my hors d’oeuvre plate,” she said.
“The injuries, losses and harms to the plaintiff were caused by the negligence and carelessness of the minor defendant in that a reasonable eight years old under those circumstances would know or should have known that a forceful greeting such as the one delivered by the defendant to the plaintiff could cause the harms and losses suffered by the plaintiff,” the lawsuit claims.

Found the case. FBT-CV-13-6033608-S (Bridgeport, CT Superior Court), but can't look it up because they are in jury selection. This is the type of case they teach in torts in law school, where you discover that yes, you can sue a child for personal injuries suffered as a result of the child's actions.
Most states have parental responsibility statutes, but that is usually for damage to property. The parent/child relationship is not subject to the respondeat superior (vicarious liability) theory. So who knows what damages she expects to collect.
She just a straight up bitch.

Or maybe this hag will just keep registering the judgment for 10 years until the poor kid starts working, and then try to garnish wages.
I think the insurance angle is probably right. Did a little digging and one theory I saw was that she tried to get the father's insurance company to pay for her damages, which they refused.
You'll note that this was the kid's 8th birthday party, and he is now 11. So this happened 3 years ago. She probably tried that long to get something, but because of the statute of limitations, she had to file suit now in order to have a chance at any recovery.
So, this may be a case where she had to sue in order to have any hope of collecting from the insurance company. She's banking on the insurance company indemnifying the father/child against any judgement against them that she receives. She's still not a very sympathetic person, but I don't think she's actually contemplating getting any money from the kid. He's just a necessary party to this action.

I see the bitch is wearing a wrist support - why? It broke 4 years ago. Wearing one of those for too long years weakens your wrist muscles - I had to wear one a couple of years ago because I sprained my wrist.
Also, look at the female Marshall on the right. How did a fat dwarf get that role? Could she really stop somebody if some serious shit kicked off? She could probably take down Jeb Bush's wife, but I think that's about it for her.

That type is far more common than you'd think in both policing and security.
This is why the aboriginal kids here keep skateboarding through the malls in town. They'll move just far enough ahead that any of the Plague of Generic Ms. Guards has to waddle-run to attempt to catch them, then stop, only moving again when she gets almost close enough to catch them. It's all very 'Cat toying with its food'.
