Caballero told jurors that he and Alvarez were not having sex and that witnesses were mistaken. Jurors listened to graphic testimony from witnesses and saw a video of Alvarez moving on top of Caballero in a sexual manner in the middle of the day while others watched.

A defense attorney said Caballero planned to appeal his case. Alvarez, who was recently sentenced to time served, filed an appeal in her case in June.

Prosecutors say they were tougher on Caballero because he previously served eight years for cocaine trafficking. Both must now register as sex offenders. The Bradenton Herald reports the jury found them guilty after deliberating only 15 minutes. The couple had faced 15 years in prison.

Prosecutors said it was important that the community knew what wouldn't be tolerated on public beaches.

Of course we shouldn't allow people to shag in public during the day where there are families watching. Perhaps this will the the next SJW cause - exhibitionist pride, giving exhibitionists the same sexual rights as everyone else.

I'm still not sure about having them put on the sex offenders list. One part of me wants to say that to be put on that list you should be a flasher, rapist or paedophile (listed in order of perversion). But then I think that having sex in public, especially in front of families, is on the level of flasher and therefore should be charged.

Sex in public is awesome. But you need to be careful. Sex on the beach should only be conducted at night or in very secluded spots. Sex in the forest should be conducted well away from the main track if it's a popular hiking spot. Sex in carparks should only happen if you are familiar with the place and know where the cameras are, and are able to shoot your load quickly. Sex in the elevator only happens in the movies.

I just spent a month down in St. Petersburg which is just north of Bradenton. I even visited the beaches on Anna Maria Island (where this happened) as the beach at the northernmost end of the island is one of the nicest in the area. They were talking about this story quite a bit when I was there.

They got busted because they were stupid. As soon as bystanders started bitching, they should have stopped what they were doing.

I don't agree with making them register as sex offenders. The sex offender registry was meant to keep track of pedophiles, not horny tourists.

How will the SJWs respond given their vast difference in age?

And who thinks she'll stick by him while he rots in the can for the next 2.5 years?

I think that having sex on a crowded beach in broad daylight is a very stupid thing to do and highly disrespectful.
But 2.5 years prison time and having to register as a sex offender for that is too harsh.
A fine and court ordered community service would have been a more appropriate punishment.
Anyway, her getting time served compared to his sentence is scandalous!
She was on top for fuck´s sake, so it was probably her idea all along.
And then the guy gets sent to jail? How does that make sense?

Some punishment - fine, but seriously 2.5 years in prison for public sex? Of course only for the man it is. This is utterly puritanical craziness. If it had been two gays, they wouldn't even be charged.

Maybe the judge was jealous as well and wanted to repay a "jerk". In France they have money fines like parking tickets. Couple hundred bucks should have been enough.

I am not a homophobe but did you see what gay men were doing in the street during gay pride after the court decision last week?! There were men shoving didios in their ass at 11 am on a fucking weekday, there were children present, and the pictures were all over Twitter- No arrests, no sex registry, no headlines about perversion just fucking rainbows every goddamn place. I am not exaggerating grown ass men were fucking each other , shoving didldos in their asses, and minors were there and no one was cited or fined. In fact they were encouraged, and straight people waved rainbow flags in solidarity. I apologize for my above post and my foul language but I am just tired of male heterosexual behavior being treated like a pathological condition. I am almost as old as that guy and 2.5 years for so exciting outdoor sex is too much. This is another stupid crap in the US legal system. What does one thing have to do with the other?

That's like a bank robber getting booked for a parking ticket after having served for 10 years and having lived a productive life for another 3. Should he get 3 years for having parked the car on the wrong spot?

There are a bunch of stupid rules in the US legal system which only serve to fill the private prison complex system (that is by the way caught multiple times at paying kickbacks to judges, lawyers and legislators). It should not have a profit-based prison system or the sheisters will be of course doing anything in their power to fill those prisons and create the biggest prison population in the world - and the US is a far cry from being the most dangerous country in the world.

Any prison time at all for this is silly, and getting put on a "sex offenders" list is extremely ridiculous and damaging. A fine, community service, and maybe some kind of "program" if you really want to stretch it would be reasonable. Prior time served for something completely different should have no influence. This one time when I was working in West Hollywood, the kitchen ran out of something. I don't remember what, parsley, shallots, some shit like that. So I had to get to the nearest grocery store (Pavillions) to pick some up. I didn't realize it but Pride parade was that day. There's gay parades practically once a month in West Hollywood so I stopped keeping track.

At 2pm in the afternoon there were thousands of drunk gay guys on the streets, doing drugs in back alleys, making out, it was disgusting. Since the streets were closed I had to walk.

On two separate occasions I was legitimately sexually assaulted by a group of fags. They started out with cat calls (Pretty white boy) and then started trying to grab my ass and grab me. The 2nd group just tried to pull me in for a photo but they were aggressive about it. I was ready to fight the dude in the first group that tried to grab me but he just started making kissing faces at me and they were all laughing like hyenas. I gotta admit, I lost my cool, and these fuckers were having a great time at my expense.

The best part of the story is that there were tons of police and sheriffs there. Despite the fact that fags were doing drugs, getting drunk, and getting it on in public, the police were there to PROTECT the gays.

It would give me immense pleasure to see that city wiped off the map.

If you see the inside of a jail cell for any one case, your chances of going to jail for any subsequent conviction skyrocket. It doesn't matter if the case for which you went to jail in the past is related to the present case. If you go to jail for one case, then you are again convicted for the same offense, you are really screwed. Also, I'm not sure we know what this guy's record was besides the prior felony drug case. It is difficult for me to believe that he had no prior record, then went to prison for eight years for drug trafficking, then caught this charge, but that he has no other contact with the criminal justice system. That being said, the sentence was extremely harsh and as much of an advocate as I am for trying most cases, this case probably shouldn't have been tried. The Defense was handicapped by the fact that this guy couldn't testify, because the state would impeach his credibility due to his prior conviction for drug trafficking.

Drug cases are usually garbage and usually go away if the lawyer is doing his job. As I've posted before, there are so many things that need to be proven in those cases that there are so many ways for the Defendant to walk. In his drug case, either his lawyer dropped the ball or it was the rare drug case in which the state (or federal government) had all of its ducks in a row.

The best is that his attorney said, "We are grateful that the state has offered 2 1/2 years." Will he be grateful when he gets hit with a post-conviction petition for ineffective assistance of counsel? Bollocks. I don't know if you guys know this, but the same attorney represented both of these people. It is an clear conflict of interest to do so, but you can waive that type of conflict if both Defendants sign a waiver, which they might have done here. In those situations, even if the people are willing to sign a waiver, I refuse to represent both of them. Too many possible headaches.

The other thing is that if you try to stop gays from doing all that sick shit, you are accused of hate and phobia -- you are the one in the wrong. And if a cop or public official tries to stop it, well then its a civil rights issue and the national media is there to make a federal case out of it.
