The next time she shows up, don't let her in and call the police. Tell her never to contact you again and put it in writing. If she then tries to intact you, get a Protective Order. At that point, if she tries to pursue any criminal charges, it will look like she did everything in revenge. If she doesn't report the incident immediately after it happened, people may also doubt her credibility. You probably don't need me telling you this, but you made a huge mistake letting her in the door. If you can bang her, you can bang a million other girls who (hopefully) wouldn't carry so much drama. Move on. Does she have any criminal record?

Edit:
If the case which is presently pending against her is for domestic abuse, that won't affect her credibility the way that a prior conviction for something like theft or forgery would. If you are now divorced and you are a witness for the prosecution in the case against her, they can force you testify against her if the marital privilege does not exist after divorce in your state.

Just an FYI, I am a private investigator, there was a question in this thread about recording people without their knowledge. Just so you know. In almost all states it is legal for you, as a party to a conversation, (not wiretapping or eavesdropping) to record your conversation. But only in some states is the recording admissible in Court. These states where only one party must consent are known as "one-party" states, where one party is consenting to be recorded. These have generally been applied to both calls and regular conversations.

In this case I would make sure all calls and conversations were recorded.

I want to thank everyone who has posted here. I have not heard anything from her since the other night.

I think my texts show that I have asked her to not to contact/show up anymore. I think I am going to send a registered letter stating the same thing and then stop in at the PD and file a report to make them aware of what has been going on. (Paper trail)

If she shows up again or makes any allegations I am already on record in regards to her behavior. Also, I still have the court appearance coming up. I will keep everyone posted.

I have not seen/heard from her or had any contact since June 16th. I spoke to an attorney shortly after that. He advised me that as I had already told the police and the State's Attorney's office that I did not wish to pursue the domestic violence charge that there was no need for me to be present on June 30th. Then he advised me to run as far away from her as quickly as I can.

I spoke to the State's Attorney and she recommended that she enroll in AA and start doing volunteer work for some charity. The SA said that they couldn't make the whole thing go away because of the felonies but that they would work with PD to make it as easy as possible: She could potentially get time served, probation (12-18 mos), counseling (AA) and community service.

She said that if she goes to AA and starts volunteering for a charity it would look good to the judge at sentencing and she would probably get credit for the time she already volunteered. This way she wouldn't get assigned to SWOP (sheriff's work program) picking up trash by the side of the highway.

I saw a friend from PD two weeks ago. She did not follow my advice. She and her attorney are apparently trying to make it into a police brutality case. She has filed stuff against the department and the state. He told me that the State's Attorney's office is now not going to play ball.

I asked him if she fucked her life. He shrugged and said "we'll see".

After the fucking I took in family court I understand the desire to fight back when you feel you have been wronged. But this is one fight she cannot win. I sincerely hope she comes to her senses and minimizes the damage. I don't want to see her ruin her life over this.

Lets step back from the trees and look at the forest (big picture) for a moment.

Whenever anyone especially a drunken female threatens you they are basically tipping their hat to you and giving you a window into their subconscious intentions if not state of mind.

In my world the threat is as good as the deed... being a good guy here and not wanting to press charges can ruin your life - in my line of work one DV and I can never get a Corporate contract again.

Therefore you must heed the ancient rules... when attacked...

ADMIT NOTHING...

DENY EVERYTHING...

LAUNCH A VICIOUS COUNTER ATTACK...

1. In this case at the minimum is get a lawyer and file a Domestic Violence charge against her as a drunken stalking slore.

2. Get a restraining order for at least 1,000 feet...

3. Next time she comes over drunken and threatening - call the police and have her arrested for violating the restraining order and Press Charges...

4. Depending how much of a psycho she is and ability to convince her convict canary friends to get even for her - change your legal name - move out of state - tell no one about and restart your life avoiding drunken psycho coonts in the future.

In reality this is a preemptive move you want her being arrested and prosecuted BEFORE she does same to you... he said she said is tough but getting a Restraining Order and her likely to get drunk again and harassing you late at night in your home will in fact get her arrested and prosecuted which PROTECTS you as now she is on the wrong side of the law and anything she accuses you of after is through the lens of her drunken idiot behavior and most likely will be ignored.

Other solutions will result in you walking around with a butt plug in the state pen for life - so unless the idea of three hots and a cot, endless TV and daily exercise with other convict psycho men intently staring at your ass thrills you refer to steps 1 through 4 above.

Being a nice guy here ruins your life.

I have seen it happen too many times.

I've been accused of false rape before. The case didn't go to court, but I've been met and questioned by the police before they decided to not pursue it.

Here's what you should do. Deepdiver got it mostly right.
1) File a domestic abuse charge against her. Be vicious.
2) Calculate your losses (if any), and make sure to sue her for that amount + some extra because of the stress. Again, be vicious.
3) Restraining order, and cease all contact with her.

Just reading your story makes me want to jump out of my chair. Counter attack, be extremely agressive, and make sure the bitch will regret even talking about rape.

If you're a logical and decent man, you know that pursuing charges is not going to fix all that is wrong with the universe.

However, doing so is a means to protect yourself.

The defense is a good offense.

Don't worry about ruining her life. Women generally get a free ride often enough that even the slightest bit of effort by her in the future to make better choices will result in her enjoying a very satisfactory lifestyle.

As it is, she has clearly not learned anything and is pursuing some lie about police brutality.

Protect yourself. Take her down (legally). Eliminate the threat.
