You may not be aware of it - most people aren't - but our legal systems are often irrationally protective of people who commit crimes of gross negligence with a car.


Eg, person drives into a nursery, nearly killing a baby. "Ohh, no one died, it was just an accident, don't worry about it."

Agreed. No man would get off so easy if he were this negligent behind the wheel. However, if this were woman on woman and under the same circumstances, I expect the posters here to call a spade and spade and harangue the driver with the same vitriol. There are some really broad generalizations being thrown around here. I know a guy, actually a pretty good friend of mine, who got off incredibly easy for a similar case. The guy was basically a model citizen his whole life, then the accident happened, then he was never in trouble again. I didn't represent him and I really doubt I would want to. I have a female client who had a similar case and received a similar sentence as my friend. I didn't represent her in the homicide case and I think it happened before I was admitted. Justin Gimelstob, the tennis player's brother had a similar case, except he actually left the scene of the accident, then turned himself in on another day. He also got a light sentence and supposedly did something similar later at home in North Jersey.

i remember watching a show on prisons where a 18 year old with no criminal record got 8 years. I just googled the penalty for killing someone while driving intoxicated and some states are pretty lenient. So merenguero is probably right.
