Hillary Clinton Used Personal Email Account at State Dept., Possibly Breaking Rules
Quote:WASHINGTON — Hillary Rodham Clinton exclusively used a personal email account to conduct government business as secretary of state, State Department officials said, and may have violated federal requirements that officials’ correspondence be retained as part of the agency’s record.

Mrs. Clinton did not have a government email address during her four-year tenure at the State Department. Her aides took no actions to have her personal emails preserved on department servers at the time, as required by the Federal Records Act.

It was only two months ago, in response to a new State Department effort to comply with federal record-keeping practices, that Mrs. Clinton’s advisers reviewed tens of thousands of pages of her personal emails and decided which ones to turn over to the State Department. All told, 55,000 pages of emails were given to the department. Mrs. Clinton stepped down from the secretary’s post in early 2013.

Her expansive use of the private account was alarming to current and former National Archives and Records Administration officials and government watchdogs, who called it a serious breach.

“It is very difficult to conceive of a scenario — short of nuclear winter — where an agency would be justified in allowing its cabinet-level head officer to solely use a private email communications channel for the conduct of government business,” said Jason R. Baron, a lawyer at Drinker Biddle & Reath who is a former director of litigation at the National Archives and Records Administration.

A spokesman for Mrs. Clinton, Nick Merrill, defended her use of the personal email account and said she has been complying with the “letter and spirit of the rules.”

Under federal law, however, letters and emails written and received by federal officials, such as the secretary of state, are considered government records and are supposed to be retained so that congressional committees, historians and members of the news media can find them. There are exceptions to the law for certain classified and sensitive materials.

Mrs. Clinton is not the first government official — or first secretary of state — to use a personal email account on which to conduct official business. But her exclusive use of her private email, for all of her work, appears unusual, Mr. Baron said. The use of private email accounts is supposed to be limited to emergencies, experts said, such as when an agency’s computer server is not working.

“I can recall no instance in my time at the National Archives when a high-ranking official at an executive branch agency solely used a personal email account for the transaction of government business,” said Mr. Baron, who worked at the agency from 2000 to 2013.

Regulations from the National Archives and Records Administration at the time required that any emails sent or received from personal accounts be preserved as part of the agency’s records.

But Mrs. Clinton and her aides failed to do so.

How many emails were in Mrs. Clinton’s account is not clear, and neither is the process her advisers used to determine which ones related to her work at the State Department before turning them over.

“It’s a shame it didn’t take place automatically when she was secretary of state as it should have,” said Thomas S. Blanton, the director of the National Security Archive, a group based at George Washington University that advocates government transparency. “Someone in the State Department deserves credit for taking the initiative to ask for the records back. Most of the time it takes the threat of litigation and embarrassment.”

Mr. Blanton said high-level officials should operate as President Obama does, emailing from a secure government account, with every record preserved for historical purposes.

“Personal emails are not secure,” he said. “Senior officials should not be using them.”

Penalties for not complying with federal record-keeping requirements are rare, because the National Archives has few enforcement abilities.

Mr. Merrill, the spokesman for Mrs. Clinton, declined to detail why she had chosen to conduct State Department business from her personal account. He said that because Mrs. Clinton had been sending emails to other State Department officials at their government accounts, she had “every expectation they would be retained.” He did not address emails that Mrs. Clinton may have sent to foreign leaders, people in the private sector or government officials outside the State Department.

The revelation about the private email account echoes longstanding criticisms directed at both the former secretary and her husband, former President Bill Clinton, for a lack of transparency and inclination toward secrecy.

And others who, like Mrs. Clinton, are eyeing a candidacy for the White House are stressing a very different approach. Jeb Bush, who is seeking the Republican nomination for president, released a trove of emails in December from his eight years as governor of Florida.

It is not clear whether Mrs. Clinton’s private email account included encryption or other security measures, given the sensitivity of her diplomatic activity.

Mrs. Clinton’s successor, Secretary of State John Kerry, has used a government email account since taking over the role, and his correspondence is being preserved contemporaneously as part of State Department records, according to his aides.

Before the current regulations went into effect, Secretary of State Colin L. Powell, who served from 2001 to 2005, used personal email to communicate with American officials and ambassadors and foreign leaders.

Last October, the State Department, as part of the effort to improve its record keeping, asked all previous secretaries of state dating back to Madeleine K. Albright to provide it with any records, like emails, from their time in office for preservation.

“These steps include regularly archiving all of Secretary Kerry’s emails to ensure that we are capturing all federal records,” said a department spokeswoman, Jen Psaki.

The existence of Mrs. Clinton’s personal email account was discovered by a House committee investigating the attack on the American Consulate in Benghazi as it sought correspondence between Mrs. Clinton and her aides about the attack.

Two weeks ago, the State Department, after reviewing Mrs. Clinton’s emails, provided the committee with about 300 emails — amounting to roughly 900 pages — about the Benghazi attacks.

Mrs. Clinton and the committee declined to comment on the contents of the emails or whether they will be made public.

The State Department, Ms. Psaki said, “has been proactively and consistently engaged in responding to the committee’s many requests in a timely manner, providing more than 40,000 pages of documents, scheduling more than 20 transcribed interviews and participating in several briefings and each of the committee’s hearings.”

Didn't bold anything specific because it should all be read. I'm guessing very few people here are in favor of her being elected on this forum. How do you guys see this playing out and affecting her chances. This is a pretty serious breach with lack of transparency which is also a problem people had with Bill Clinton. I'm guessing this was leaked by someone with her so it would be easier to forget later on in 2016 and she has time to formulate a response but there really is no positive way to hamster this.

It won't. Believe me right here and now: they WILL find a way to hamster this. It was an "aide", she didn't know the rules, accident, etc. It won't affect her chances. It should, but it won't. Remember it's all team women in politics these days. She'll get the pussy pass she desires.

Colin Powell allegedly did something like this with a Yahoo account. Difference is that, back then Cyberwarfare was nothing like it is today. Old habits may have cost her something here. Even with a pussy pass, this could be quite damaging during the debates if some of the candidates are quick witted enough to pull out this card at the right time. After Snowden, the China hackings, the Russian hackings, etc., the govt. clamps down much harder these days.

Of all the things to attack a candidate with, attack your opponents stance on issues, not something as inconsequential if they sent their email from state.gov or from nsa.gov.

I don't think this will hurt her too bad. To touch up on what another poster stated, the issues will make or break her, not this. Besides, if the MSM wants her to be the Democratic nominee, so it will be.

This is big actually. It's the law that she needs to conduct official business on the State Department email system. She broke the law.

The reason for the law is important. The State Department business is part of the public record. It provides transparency to what they are doing. People can ask for information using the FOIA act and the State department needs to cough up the info if it meets certain criteria. But if her emails are not on the State Dept server, the law is skirted.

All official documents are to be archived too for historians and researchers.

Those emails she conducts on official business are not hers, they belong to the American people.

Furthermore, if there is a scandal or otherwise people are suing her or the State Department, there's no email trail from the State Department server.

She broke the law. This is a pattern of hers going on for decades. Lie, cheat, evade, obfuscate ..the laws don't apply to her.

She's an entitled cunt who thinks she's above the law.

Take care of those titties for me.

Clinton was not the first secretary of state to use a private account. The State Department said Clinton’s successor as top diplomat, John F. Kerry, is the first secretary to use a standard government e-mail address ending in “state.gov.”

Congress said it learned last summer about Clinton's use of a private email account to conduct official State Department business during its investigation of the Benghazi attacks on a U.S. mission in which four Americans died.

"It doesn't matter if the server was in Foggy Bottom, Chappaqua or Bora Bora," House Speaker John Boehner said. "The Benghazi Select Committee needs to see all of these emails, because the American people deserve all of the facts."

The chairman of the Benghazi committee, Rep. Trey Gowdy, R-S.C., told reporters: "I want the documents. Sooner rather than later."

Democrats called it a fishing expedition.

"Everything I've seen so far has led me to believe that this is an effort to go after Hillary Clinton, period," said Rep. Elijah Cummings of Maryland, the top Democrat on the committee.

The questions about Clinton's email practices left the Obama administration in an awkward position. At one point, the State Department directed reporters to contact Clinton, who has not publicly commented about her emails. The White House said it was her responsibility to make sure any emails about official business weren't deleted from her private server.

Meanwhile, the AP said it was considering legal action under the U.S. Freedom of Information Act against the State Department for failing to turn over some emails covering Clinton's tenure as the nation's top diplomat after waiting more than one year. The department has never suggested that it doesn't possess all Clinton's emails.

It was not immediately clear exactly where Clinton's computer server was run, but a business record for the Internet connection it used was registered under the home address for her residence as early as August 2010. The customer was listed as Eric Hoteham.

An aide to then-first lady Clinton was identified in a 2002 congressional report as Eric Hothem, whose name is spelled differently than in the Internet records. Hothem, a financial adviser in Washington, was not available to take an AP reporter's phone call at his office Wednesday. He was a special assistant to Clinton as far back as 1997 and considered one of the family's information technology experts.

A parody Twitter account for Hoteham appeared Wednesday after the AP cited the records, sending satirical tweets supporting Clinton's campaign. Hoteham's name had not appeared with that spelling in public-record databases, campaign contribution records or online background searches.

In most cases, individuals who operate their own email servers are technical experts or users so concerned about issues of privacy and surveillance they take matters into their own hands.

Clinton - who emailed so frequently using her BlackBerry as secretary of state that it became an Internet meme - is particularly sensitive about disclosures of personal files based on her experiences in confronting congressional investigations and civil lawsuits during her husband's election and presidency and her own roles as first lady, senator, presidential candidate and Cabinet official.

State Department spokeswoman Marie Harf said Clinton as Cabinet secretary never used a government email account on the agency's separate network for sharing classified information, which Clinton would have been prohibited from forwarding to her private email account.

"She had other ways of communicating through classified email through her assistants or her staff, with people, when she needed to use a classified setting," Harf said.

Most Internet users rely on professional outside companies, such as Google Inc. or their own employers, for the behind-the-scenes complexities of managing their email communications. Government employees generally use servers run by federal agencies where they work. Clinton's email practices appear to be far more sophisticated than some politicians, including Mitt Romney and Sarah Palin, who were found to have been conducting official business using free email services operated by Microsoft Corp. and Yahoo Inc.

Clinton has not described her reasons for using a private email account - [email protected], which appears to include a nod to her middle name, Diane. A spokesman for her did not respond to requests seeking comment from the AP on Tuesday or Wednesday.

Operating her own server would have afforded Clinton additional legal opportunities to block government or private subpoenas in criminal, administrative or civil cases because her lawyers could object in court before being forced to turn over any emails. And since the Secret Service was guarding Clinton's home, an email server there would have been well protected from theft or a physical hacking.

But homemade email servers are generally not as reliable, secure from hackers or protected from fires or floods as those in commercial data centers.

The Hoteham registration is also associated with a separate email server, presidentclinton.com, and a nonfunctioning website, wjcoffice.com, all linked to the same residential Internet account as Mrs. Clinton's email server. The former president's full name is William Jefferson Clinton.

Hothem, the former Clinton aide, surfaced in at least two Clinton administration controversies. A congressional report in 2002 investigating pardons said a Citibank account linked to Hothem wired $15,000 to President Clinton's brother, Roger, in March 2001, while investigators were trying to compel Roger Clinton to testify about his role in several pardon cases. The president's lawyer told investigators the money came from a personal account of the Clintons and was intended for Clinton's brother to hire a lawyer.

In early 2001, Hothem was also named by a former White House chief usher as saying the Clintons were permitted to take furniture when they left the White House that later was determined to belong to the government.

Sue Hothem, his wife, is a well-known fundraiser and political consultant in Washington. Last year, she was named a vice president for the technology lobbying group TechNet. It said she previously headed development efforts for the Democratic Leadership Council and the Progressive Policy Institute.

Mrs. Clinton's email options included using an official State Department account or even a secret agency email address, which the AP revealed in 2013 as a common practice across the U.S. government and by previous administrations. Many senior U.S. officials use alternate addresses that aren't disclosed to the public for official business so they are not inundated with unwanted messages.

But the State Department's email system might not have been attractive to Clinton because it is frequently targeted by hackers. The AP revealed in 2006 and 2014 that the agency had suffered significant electronic break-ins. In the most recent incident, the department took the unprecedented step of shutting down its entire unclassified email system. While Clinton was secretary of state in 2010, a U.S. soldier, Chelsea Manning, stole 250,000 diplomatic cables and turned them over to WikiLeaks, which published them online.

This just gave it away. Bolded for emphasis. A personal email server is extremely fishy.


For someone who receives massive amounts of hateful messages, a Roosh or manosphere writer I could totally understand having a personal email server. In fact, I'd recommend it.


But there is no reason why a government official would either set up a personal server themselves, or hire someone else to set it up for anything other than nefarious reasons. And nefarious reasons which affect the citizens who propped them up.


We'd also want to check the recipients of her personal emails. I doubt they were GMAIL or OUTLOOK accounts.

This is NOT inconsequential. If you use gov't email, THEY OWN THE EMAIL! The next administration will have them, and at some point you will be accountable for everything you've ever done. With your own email, you decide what you'll be accountable for, and what the people will find out and when. Two very different beasts.

The wasn't an accident, this was a careful strategic decision.

To expand on this, it allows you to act faster, looser and dirtier than anyone else. We all act different when we're on camera. She was willing to take a big risk (as demonstrated here) just to keep her real actions and motivations hidden.
