A cursory glance of the criminal complaint reveals glaring gaps in the story of the "victim."

The "victim" describes two prior incidents where Cosby macked on her before the alleged criminal incident.

In the first incident:

Quote:After dinner, she and Cosby where sitting on the sofa when, without warning, Cosby reached over and touched her pants, her waist, and inner thigh.

In the second incident:

Quote:She had consumed a couple glasses of wine and was talking to him when "out of the blue" Cosby unbuttoned her pants and began touching her.

She alleges these two prior incidents, yet she continues to make social visits where she is alone with him. But not only that, it gets better:

Quote:Despite these advances by Cosby, the victim trusted him and continued to accept his invitations to social and professional functions.

Sound fishy yet? Keep going. After the alleged drugging and finger bang, the report to the police is anything but typical of a person who suffered sexual assault and battery.

Quote:The victim told investigators that she left the residence without saying anything.

Fast forward about one year after the alleged incident took place (an ambiguous date in the report, "sometime between mid-January and Mid-February of 2004"--a date that should be clearly etched in a true victim's memory). The "victim" had not yet gone to the proper authorities.

Quote:[T]he victim left the Philadelphia area and returned to her parents' home in Canada . . . the victim's mother . . . noted changes in her daughter. . . . [T]he mother attempted to find out from her daughter what was wrong with her but the victim simply did not answer.

After the alleged incident, the "victim" skips town and mopes about her parents' house. But the "victim" eventually spills the beans.

Quote:Eventually, on the morning of Thursday, January 13, 2005, the victim told her mother that Cosby had sexually assaulted her. Shocked and devastated . . . [the mother] reported the incident to the [local Canadian police]. . . . On January 14, 2005, a representative of the [local Canadian police] forwarded the victim's report of this incident to the Philadelphia Police Department Special Victim's Unit.

The "victim" told her mother who then reported the incident to local police outside the country that have no jurisdiction over Cosby. And this is at least 11 months after the alleged assault. Any physical evidence of the sexual assault has surely gone stale.

An investigation of the incident was opened in 2005, but eventually died.

Quote:The initial investigation into this incident was reviewed by [the] District Attorney . . . and resulted in the issuance of a February 17, 2005 Press Release, which announced that no criminal charges where forthcoming.

What does this mean? The authorities tasked with enforcing the law investigated the situation and found that the allegations were not credible. The depositions from the "victim's" civil case against Cosby are now in the public domain and may be used against him, but even that help is going to make it hard for the Commonwealth to put together a decent case against Cosby. Its prior decision not to prosecute makes that abundantly clear.

This case seems to have all the hallmarks of a false rape accusation. Even when you look at the narrative of the "victim" alone, it has more holes than a swiss cheese. I don't think it's going to stick.

And yes, I think this entire case, with no physical evidence is going to be a very tough sell. Don't you need some sort of evidence other than "he raped me!" to get a conviction?

It would be extremely interesting if Constand was outed as a liar — or better yet, if she confessed that her story is untrue — as she is the original Cosby accuser, the one who opened the floodgates for all the others.

But even if that happened, you'd no doubt continue to hear people repeating the "Where there's smoke, there's fire" line, and insisting that just because the original accuser was shown to be full of shit, it doesn't mean that all the women who followed her are lying, too.

Yes. The evidence to convict may be circumstantial, but because this is a criminal case, the evidentiary proof must be beyond a reasonable doubt. The prosecutor has the burden to provide sufficient evidence to the jury for them to conclude with reasonable certainty that Cosby actually engaged in felonious sexual assault.

The "victim" in a certain sense won in the civil litigation against Cosby, but the reason was twofold. First, in civil litigation, the evidentiary burden of proof is lower. To win a civil sexual assault case for monetary damages against someone, the standard of proof is a preponderance of the evidence (it's more likely than not that the person committed the assault). Second, the "victim's" case never went to trial because Cosby settled with her. Regardless of his culpability, he wouldn't have wanted the allegations to see the light of day back in 2005. Since he had the money, he simply paid her to go away and sign a non-disclosure agreement.

In the end, there are no winners only casualties

How can you pursue a case where the evidence has been compromised, memories have long faded, and more than four decades have passed?

Not to mention at this point any jury/judge would be effectively poisoned from the sensationalism by which this case has been handled.

What you are left with is nothing more than bad decision making, the sting of rejection and the curious timing of a united front of opportunistic individuals.

All squarely aimed at a wealthy defendant, with more than just a passing interest in making this all go away.

I agree-the nature with which these allegations have been trotted out make it clear that the end goal is for Cosby to break out his checkbook. His accusers probably misjudged his tolerance for embarrassment. Upon the initial threat of revealing his private dealings, some would have thought he would go into an all out defensive posture to protect his image. For the most part, he maintained a stiff upper lip.

More than anything, it sounds like Bill's only crime is being a pompous and unapologetic playboy.
