An older Swedish couple with one child decided to seek help conceiving another, but were forced abroad as embryo donations - where both the egg and the sperm come from third parties - are not legal in Sweden. The man, however, claimed he was clear about wanting just one child, partly because he and his wife are both in their fifties, and the couple ticked a box stating so on the consent form.

The first attempt did not work, but the wife travelled abroad again for a second try, this time leaving her husband at home. At the clinic, she amended the consent form to allow the staff to implant two embryos at once. She did not tell her husband. The second attempt failed too, but the woman persisted, again travelling abroad for a third procedure. Yet no matter her desire for another child, the news that she was expecting twins would cost her her husband.

Today, the court of appeal has established that they don't change the decision by the district court.

Both the egg and sperm came from third parties?

That's enough for me to lose respect for both people in this couple. I don't care for what troubles they have later on.

Don't forget to look at the principal matter of the case.

The court of appeal is saying that a father's consent to have his common law spouse / wife impregnated at a clinic can't have any limitations, it can only be revoked though.

This means that she can go to the doctor and maybe after 2 failed attempts with the husband's sperm decide to use someone else's or decide to have 5 kids, and the husband can effectively be forced to become the legal father of 5 kids that aren't his biologically even if he only gave consent to have a biological child of his own.

Basically, if someone ever in their life is going for such procedure and living in Sweden make sure to write the consent form at the clinic, oversee the procedure yourself and then revoke the consent as you walk out of the clinic. Otherwise, you might intend to have one biological child of your own but end up being the legal father of one or more children that aren't even yours biologically. We will see what the Supreme court might say about this though.
