The Supreme Court on Wednesday convicted a father of raping his daughter 27 years ago, rejecting the father’s appeal in a case that had gone on for more than a decade.

The case involved a complex legal question stemming from the daughter’s memory of the rapes, which began when she was three years old and continued until she was 11. The woman, now 38, repressed her memories of the acts until she was 22, when she awoke from a dream that her father had raped her, and began for the first time acknowledging what he’d done to her. Three years later, in 2002, she filed a police complaint.

This is the first rape conviction in Israel based on repressed memories.

Wednesday’s conviction came after the father had been convicted twice in Tel Aviv District Court. He was first convicted in 2007, but his attorneys asked the Supreme Court to return the case to the district court to further examine the issue of repressed memories, which were not dealt with in the original case. The district court heard evidence from experts in repressed memories, then again convicted the father, who appealed once again to the Supreme Court.

The bench, headed by Justice Edna Arbel, sentenced the father, who is now 75 years old, to the original sentence set by the district court – 12 years in prison. Over the years the beginning of the sentence was delayed, and the man is now set to begin his term on October 20.

The complainant, now 38, testified that her father raped and sodomized her from the age of 3. Because of the statute of limitations, he was convicted of rapes that took place when she was 10 and 11 years old.

The father said his daughter had made the whole thing up because of psychological problems. He and his wife divorced when the rapes came to light.

The daughter testified that from the age of 11 she suffered from anxiety attacks and dropped out of school in the ninth grade. When she was 22, after six years of therapy, she moved to New York.

There, in October 1999, she testified that she had been studying about the unconscious mind and subsequently remembered the rapes for the first time when she awakened from a dream.

She said she realized that she had been dreaming the same dream as long as she could remember, especially as a teenager.

“I felt like I wanted to take a knife and slit my wrists,” she said.

The father came to court on Wednesday for the reading of his sentence accompanied only by his attorney, Gil Shapira, of the Public Defender’s Office. Justice Salim Joubran informed the defendant in one sentence that his appeal had been denied.

The father, his voice shaking, told reporters, “The injustice done to me today is terrible. A dream my daughter had 15 years ago has destroyed my life. Other than the dream there is no proof. I waited two and a half years for the Supreme Court to correct this injustice and they have sentenced me to end my days in jail based only on a dream.”

The daughter’ attorney, Uri Kedar, said: “We are very glad this story is over ... You really never recover from incest ... The court showed the victim that there is justice in the world and told other victims that they can go to the police.”

The man went all up to the Supreme court battling the system for 15 years. Sentenced by a judicial system that lets a "dream" be proof is just plain-bat-shit-crazy.

Now I do not even care whether the guy did the abuse or not. The reason why the judicial system was set up to dismiss cases due to lack of credible evidence is because if you don't do that, you get a LOT of innocent people locked up. The US had such a more or less just system even 100 years ago. Sure - sometimes a guilty party walked free, but that was a small price to pay for the hundreds that would be sentenced due to various fake or personal reasons.

Of course they could have put both the father and the daughter into deep lucid hypnosis and find out who tells the truth. But we likely will never see deep hypnosis being used by a corrupt judicial system due to the fact that the need for lawyers & the entire law & order machinery would drop tremendously. Then we might finally see more truth win instead of the bigger wallet or in this case the prevalent feminist rape agenda.

Still a fucked-up world, where a man can be convicted of rape based on a dream your college hook-up had. Let's call it repressed memories and you are done for.

It's incredible. I could stomach him being sentenced just on the basis of someone's word, as outrageous and unfair as it is. But a dream???? And in Israel of all things, not in the anglosphere?

I... I just don't know what to say.

At least this gives the phrase "bad dream" a whole new meaning. I'd laugh at the pun if it weren't so sad.

It's funny how time gives you perspective on these things.

Many of you younger G's may be living through your first media-induced bullshit panic: the "campus rape" crisis. All the talking heads in the echo chamber insist it's true, but when you dig into the evidence, you find there's nothing there.

It may or may not surprise you, but we've been through all this before. Back in the 1980s, the media was promoting some bullshit about Satanists taking over our nation's day care centers and power-hungry DAs sent a lot of innocent people to jail over it. I seem to recall "recovered memories" first gaining credence in some of those cases, and then eventually taking on a life of their own, until psychological research and a bunch of civil suits against the therapists involved in RMT shut it down. To the OP, who suggested "deep hypnosis" would solve the problem, hypnosis is one of the techniques that they use to elicit these "recovered" memories. If you put a person into a highly suggestible state and ask them lots of leading questions that imply they were raped and were suppressing the memory of it, they come out believing that they were raped and suppressing the memory of it. Surprise, surprise. Watch "The Manchurian Candidate" if the implications remain unclear to you, or if you want to see Sinatra at his best as an actor.

So, I guess my point is that once you get old enough, everything old is new again, and I'm sure Israel will go through a similar cycle to what the U.S. experienced.

Pretty depressing, huh? Enjoy the decline.

What I rather meant was a technique in hypnosis where you reach a higher level of awareness - Soul if you may call it - completely beyond emotions and even all mental engrams as a human. Hardly any hypno-therapist is doing that.

But you are right - it would likely be misused with even greater abandon, since you can imprint all kinds of fake memories and suggestions into someone.

Either way - regardless of my or anyone's personal opinions - the "evidence" in this case would not even merit a police investigation, let alone a court case up until the supreme court.

The assistant DA should have said: "What? Your dreams or vague recollections as the only evidence? Sorry, mam, but you should reassess your mental state. And even if you were right and you were completely lucid (which I doubt at this point), then we would not be able to do anything since it is your word against your father's. We would have to assess your entire psychological history and if we find any reason to believe that you are emotionally or mentally unstable, then there is no way we can open the case." Case closed.

Just getting crazy - ah - well enjoying the decline is the only option.

This is why juries are so great. Chances of 12 people agreeing he was guilty (10 out of 12 in some places) is slim.

Judges in civil law jurisdictions also come from prosecution careers, so there's a big bias there.

Maybe some of you guys are too young to remember this but for over a decade there were sensationalist pieces coming out every year about satan worshippers in America's heartland. The stories sounded like they came out of a B-movie containing lurid details like animal sacrifice, kiddy diddling, blood orgies, and murder. The kiddy diddling part of it received the most attention in the media. Journalists and the "outraged" public were practically fondling themselves while talking about it.

There was something really disturbing going on in America's psyche. It was a full blown witch hunt atmosphere with pseudo science being used to "prove" guilt. All the usual charlatans started coming out of the woodwork to jump on this cottage industry. Hypnotists, writers, satanic "experts", and various psychiatrists were used to induce confessions and accusations from small children. Parents were thrown under the bus without much proof. It reached peak hysteria in the late 80's/early 90's then slowly petered off when more sensible people realized it was 100% horseshit.

This current trend of baseless rape accusations is very similar to what we've seen before in the past. Feminism's use of rape hysteria is the new moral panic

I would argue that this is rather a contemporary thing and should not come as a surprise in the current anti-Muslim times. The Palestinian should have known that this could have repercussions. I would not expect any fair trial in current times in Israel as a Muslim or Palestinian. But that is just common sense.

In the relatively peaceful times of the 1970s this might have been ignored, but certainly not now.

For the Dream-rape-case however the convicted and and his daughter were Jewish, so the case is really ridiculous.
