The only drawback is real rape cases may not come forward, but it may be the only way to return the favor to the person who intentionally ruined a man's life with false accusations.

I'm surprised more falsely accused men don't do that. A civil suit would be my first priority if I was in that situation.

These suits don't happen for economic reasons

Few lawyers will take a case like that on contingency, and then only if the accuser has very substantial assets or insurance to cover libel claims, either of which is very rare I'm sure

Otherwise the guy will have to pay a lawyer out of his own pocket which between billable hours and costs will easily run into tens of thousands of dollars

Even if he did eventually win the case he would likely get no money and only a fraction of the coverage the media gave to the allegation

There really is no justice for men falsely accused of rape in the current system

I think 6 of the last 7 O'Brien Award winners have gone on to win the Heisman, so Winston is the odds-on pick to win it. Pretty amazing for a [edit: red shirt] freshman.

Calling Manziel the first freshmen to win the Heisman when sophomore Mark Ingram was actually younger than him, is kind of a misnomer. I don't like it myself. When an 18 year old true freshmen wins it, that will be an accomplishment. Tebow was a true sophomore, and that was really something special because the bias against underclassmen ran so deep with the old timers.

RE: Jameis Winston Not Charged
What was interesting about the Heisman vote was that Winston's name was left completely off of 113 ballots. So even though he still won by a huge percentage over the second-place finisher, there were still a lot of voters that simply refused to consider him for the award period.

I'm aware that Winston is a redshirt freshman - I simply failed to mention it. True freshman rarely start (and if they do, they don't have the numbers he put up), but I STILL consider it an accomplishment for a guy in his teens to have the kind of season he had in his first year starting, at that position. Tebow winning it opened the door for underclassmen to be seriously considered. Though he was no doubt the best football player in the land that year (not necessarily the best QB), it was a lot of the non-performance intangible qualities that got him the award. If you look at who the voters are, he's the kind of person they think truly personifies the award. They were dying for a guy like that to present himself. Often when it comes to voting for awards, the sports media are largely jokes. No MLB player has ever been a unanimous selection to the Hall of Fame, because some writers way back when didn't put Babe Ruth in unanimously. So if the great Ruth didn't get in unanimously, writers throughout the generations since have continued to repeat the same stupidity the others did. Just on some silly principle, some writers will withhold first place votes even though they know a guy is a no-doubter.

RE: Jameis Winston Not Charged
Actually, I was wrong. Winston's name was left off of 115 ballots. And one of those voters was Eric Crouch, the 2001 Heisman winner. He cited "the unknown" for not putting Winston on his ballot...

http://tracking.si.com/2013/12/16/former...=obnetwork

Naturally, in the comments, some whiteknighters are in agreement with Crouch, calling Winston a rapist. They claim that Winston wasn't really exonerated, but the DA didn't charge simply because they didn't think they could get a conviction beyond a reasonable doubt. Yeah...they couldn't get a conviction because they determined the chick was lying...

According to the story on nfl.com...

http://www.nfl.com/news/story/0ap2000000...is-winston

"Crouch said he voted Arizona tailback Ka'Deem Carey first. That's a bit puzzling, given Crouch's reasoning for leaving Winston off his ballot. Carey was suspended for the first game of the season for a violation of team rules. Wildcats coach Rich Rodriguez never said if the suspension was related to two off-field incidents Carey was involved in, including a misdemeanor assault arrest in December 2012 for an incident involving his then-pregnant girlfriend. The charges were dismissed."

Hmmmm...Crouch's reasoning is curious indeed.

Given the circumstances and how this whole thing was portrayed (and how the accused is basically guilty until proven innocent, at least in public rape cases) I'm not surprised a lot of voters just couldn't get there on Winston, even though he was the clear choice. For a typical blue pill dude it's hard to separate the wheat from the chaff and put it all into context - doubly so if said voters happen to be footballers like Crouch or whoever and not some sort of highly logical thinker, legal eagle, etc. Let's face it football players aren't exactly always the brightest tools in the shed.

Frankly, I'm slightly surprised it was only 115 voters and not more - the feminists have done a bang up job of scaring men about 'rape culture'. Even though Winston was the pretty clear favorite you are always going to have people that vote a certain way due to internal biases, team or conference affiliations (let's face it the ACC sucks in football Smile ), the 'white knighting' mentality (which is very hard to break), etc. So I can see how many guys could go another way and rationalize it.

I think it's appalling that in are glorious and free modern day America that Winston's name was plastered all over the headlines before he even had a chance to defend himself and/or the case was dismissed. Chalk it up to the 'rape culture' bs and anti-male laws we have plus the ever-present love of the sports media to get all over these these things and create a story where there is none. But it's pretty scary. And I'm saying that as a guy who is no fan of superstar athletes and the idolization of sports stars and the sports themselves.

RE: Jameis Winston Not Charged
I understand WHY many wouldn't vote for Winston under the circumstances, but Crouch stepped forward and put HIS reasoning out there. Given he was a jock, he knows exactly what it is to be BMOC and deal with these co-eds. Then he admitted to voting for a guy that actually WAS charged for slapping up his then-pregnant girlfriend, along with another off-the-field scrape that led to him being suspended for his team's opener. He went the morality route, which in and of itself isn't objectionable, but then voted for a guy that was arguably worse. That's what I don't get.

I am so happy Winston won, and I don't even watch much football or college football at all. As a former NCAA athlete who was put into a similar false accusation situation, except in my case my teammates etc did not stand by me, this is a fucking incredible comeback story.

FUCK YEAH!

So even though he didn't rape her the school has to pay her money because they ignored her lies.

http://www.usatoday.com/story/sports/nca.../79299304/

Quote:Florida State has settled a federal Title IX lawsuit with Erica Kinsman, a former student who said she was raped by quarterback Jameis Winston in 2012.

The settlement was announced on Monday, more than a year after she initially filed the complaint in federal court.

FSU agreed to pay Kinsman $950,000 – an amount that includes attorney’s fees – as well as make a five-year commitment to awareness, prevention and training programs. The lump sum is the largest settlement for Title IX claims regarding indifference to a student’s reported sexual assault.

“I will always be disappointed that I had to leave the school I dreamed of attending since I was little,” Kinsman said in a statement. “I am happy that FSU has committed to continue making changes in order to ensure a safer environment for all students.”

FSU did not admit to liability in the settlement, which university president John Thrasher said the school agreed to in order to avoid additional litigation expenses.

“We have an obligation to our students, their parents and Florida taxpayers to deal with this case, as we do all litigation, in a financially responsible manner,” Thrasher said in a statement. “With all the economic demands we face, at some point it doesn’t make sense to continue even though we are convinced we would have prevailed.”

The settlement does not affect an ongoing Title IX investigation by the Department of Education’s Office for Civil Rights. Kinsman filed a complaint with the agency in early 2014 and it opened an investigation in April of that year.

I also read leaked docs that say the lawyers kept around 75% of that fee, and Kinsman got the rest
