I know this might sound obvious to some people, but if you're tussled up the cops: DON'T TELL THEM ANYTHING! They will use it against you. Remember, the cops are not on your side. They are just trying to get convictions.

Sad story: My buddy was fooling around with this drunk girl. Next morning, she has regrets and claims the he raped her. (Somehow she knew this even though she couldn't remember last night.) So the police ask my buddy a deceptive question "Did you have sex with her or did you just touch her a little?" This question made my buddy think that "just touching her" would be a plausible excuse. He tells the cops he only penetrated her with his finger. Boom! He just admitted to rape.

Know your rights. The cops will give you a rough time, but you never have to tell them anything. Demand a lawyer. They will make a lot of threats but in the end they can't force you to speak.

But for a misdemeanor not saying anything is sure to lead to some phony arrest and lawyer fees.

Your friend should have spoken to a lawyer or a wiser person before speaking to the police.

Police are never, never your friends. If it´s something minor they might let you off, not because they have sympathy for you, but only cause they think your offence is not worth the paperwork they have to fill.

Now he needs to find out why she´s lying. Sometimes offering money leads to people to drop the charges. But on this case, probably not...

Counteratacking putting a criminal charge against the girl for lying to a public authority and for trashing his name. Normally people that put unfounded charges dont realise that the other part can do the same. When they become the target things change.

Second investigate if she had problems of this nature before. Talking with exboyfriends is crucial. Also her criminal record might show some precedents.

Being easy or thinking because his inocent nothing will happen is a huge mistake. He should from the begining try to kill the charge before it grows into something too big.
Hiring a good lawyer is the first step.

Rape and accused rape are difficult to deal with. it should should be handled by an EXPEREINCED lawyer, especially if there is a possible history of false rape charges from the chick. Atleast in the US, there are rape shield laws, that need extra time and preperation to perice or get around. Designed to protect those who come forward about getting raped, these laws can and often are abused so women can keep claiming rape instead of taking responsibility for their own actions.

I never have problems with the police. In fact, some of my best drinking buddies are cops or work in law enforcement. Help them out as much as you can, as long as they dont ask you questions about yourself or what you were doing. You dont need to answer those kind of questions without a lawyer being present, remember, it is your right not to incriminate yourself. Even general statements can be quoted out of context if they really want to drop the hammer on you.

I dont agree with the help them out aspect. Being summoned as a witness or bullshit like that blows. Just say you saw nothing and did nothing and try to go on your way. And in some countries claiming to have seen shit can be very bad when organized crime is involved.

As a lawyer and former cop: never tell shit.

They will try to get you to incriminate yourself. ANYTHING you say will be used against you.

For minor offenses (like a red light or blasting your music too loud), it might be a good strategy, if the cop seems cool. "Excuse us sir, we didnt realize the music was bothering the neighbours, yes sir wont happen again, yes sir, ill make sure that my guests quiet down" etcetera.

But for anything else, the best strategy is to go into autistic mode and just zip it. Let your lawyer do the talking.

By the way, is better to get a cheap lawyer that one of the state appointed ones. They really dont give a fuck, as they dont get paid extra if you walk, so 90% of the time they just try to get you to agree to a self incriminating deal.

The entire legal system is of French-Norman legal construct. Police are duped into believing that their efforts are to keep order and justice in society.

It's all b.s. The legal system, from convicting serial killers to petty false rape accusations, are now and always have been for quite some time (at least since laws have been codified in the 50's), to force you into business with them. It's a pecuniary system that can only be beat with pecuniary means.

Unlocking the "code" is what some lawyers attempt to do, but essentially fail much of the time. You beat the system by accessing Common Law and the UCC (Uniform Commercial Code).

.. just pulled over - or - approached by police ..

Me: (rolling window down 1.5" enough to be heard, doors lock, voice recorder rolling - optional), "What's the problem officer?"
Cop: "License and registration"
Me: "I asked what the problem was? Do you understand English?
Cop: "Give me your license and registration or you're going to have a big problem buddy!"
Me: "I don't wish to do business with you, are you forcing me to do business with you? I've never met you in my life! I don't do business with people I don't know."
Cop: "Look, if you don't give me your license and registration I will drag your ass out of the car and detain you for disorderly conduct, obstruction of justice, and failure to provide identification after I've established probable cause to pull you over!"
Me: "Now that you've used colored pretense of law, and threatened me with bodily harm, by all means officer, I'll provide you with my license and registration against my will, but I'm obligated to inform you that the name on that license is my Common-law Copyrighted Property, and the fee for it's unauthorized use is quite steep, $500,000 per each and every occurrence, (hands officer 2-page copyright notice)."
Cop: "Is this some kind of joke? You should know you can't believe all the stuff you read on the internet.."
Me: "No, it's not some joke, it's quite serious in fact, the Self-Executing Security Agreement you'd be entering by writing my name on any document, or referring to me audibly by this name, which is my property, in attempts to open an account on me initiates the contract you will be entering in to!"
Cop: "Hold on I'll be right back.." (15 minutes elapses)
Cop: "Here's your stuff, get out of here." (cop grumbles something as he walks away..)

Five times I have used similar methods, four times in the state of Ohio and once in Michigan that went to hearing in which the judge whispered to the Bailiff just before my name was to be called in alphabetical order for a traffic violation; "I'm not going to hear this case in front of all these people.." - nothing happened.

The bottom line is this works if you have not physically hurt someone. Even if being accused.

In one instance in Ohio, a bar fight broke out, I was smashed and just sober enough to explain myself and the copyright implications. The end result was hearing the police call in my name to the dispatcher and explain what I had just presented to them. The dispatcher said:"Ask Mr. Wilson what he would like us to do for him!"

I was floored, the police actually at work for me? The cop explained he couldn't let me drive, but would give me a ride home, which he proceeded to do at my request 20 miles outside of his precinct half way across the city.

I don't blame the police for not really understanding the "just-us" system they think they're upholding. It's all a sham. The system is built to "protect" tax-payers from hurting one another, otherwise they can't pay tax and feed the French-norman legal system that allows them to exist in the first place.

Unless you murdered or raped a law-man's relative, or a wealthy person's relative who is intertwined with the "system," or politician's relative.. you're really just a mark in the debit or credit column in the Codified System's check book. Don't forget it!

^^^ Sorry, that sounds like a bunch of nonsense. Common law copyrighted property? What is that? In the US copyright is a federal law (17 U.S.C) that would certainly preempt any state common law. Or are you suggesting there is some kind of federal common law that governs copyright?

I don't know what the U.C.C has to do with anything here...it is applicable to the sale of "goods", as defined in the U.C.C. I don't think any sale is going on here.

Also, how is taking your license considered a public performance of your allegedly copyrighted work...which is what copyright is basically intended to protect. Also, how would that not fall under the fair use exception?

Law was codified because it became so expansive the common man could not understand it, nor safely stand in defense of himself anymore. It's sad really.

The above link's materials and teachings have gotten guys out of lengthy prison sentences for felonies from what I understand. At that point however, you will likely need an attorney specialized in Common Law.

Needless to say, you really have to have your shit together to use these instruments to their fullest extent.

Here in the UK there is common law which everyone is bound by, and statute law which you are only bound by if you agree to it. When a police officer reads you your rights etc and asks you if you understand, they are not asking if you comprehend the meaning of what has been explained to you, but if you agree to stand under the statute laws that they are explaining to you.

There was a police reality TV show on a few months back where a man was arrested on suspicion of drunk driving. He was barely able to stand up and slurred his words. He was taken back to the police station to be breathalised, and agreed to provide a breath test if he was paid the sum of one million pounds. They tried to breathalise him several times and each time he agreed to provide the breath test if he was paid. He was kept overnight and released the next morning without charge.

Accessing common law is what enables you to create the Common Law copyright Notice instrument on your name to begin with, with any legitimacy. The ALL-CAPS straw man name is what you are severing the surityship of between yourself (the sentient flesh and blood human being) as the straw-man name. You also regain owner ship of that name after severing surityship. It turns the person using your name into the "user" and you the "Secured Party."

The Copyright Notice is published 4 times consecutively in a nationally circulatable newspaper's Legal Notices Section.. the legal equivalence of "hear ye hear ye, Mr. Wilson is hereby the owner of this common law copyrighted material." The public, including the police, judge, laymen, have all been put on notice.

The UCC plays an important role to file a UCC Financing Statement (which is tricky to do in some states, and to be safe, should be done in the county, or state where you reside or may spend any significant time in). This UCC Statement is used to protect all the All assets, land, and personal property, and all interest in said assets, land, and personal property, now owned and hereafter acquired, now existing and hereafter arising, and wherever located, described fully in a Security Agreement you establish for your assets.

Other important instruments that must be created are:
~ Hold Harmless and Indemnity Agreement
~ Private Agreement - where you establish you are not an accommodation party or suretor for "debtor" or the ALL CAPS name.

Once the Law-man uses your name even once, it is up to you to record the occurrence, be it by writing your name, speaking your name (in court you could subpoena the audio log as evidence if in front of a judge). In court in MI, I put the bailiff, officer, and judge all on notice before my court date. Every single cop in the court house filed in behind me to see how it was handled before they would have called my name. I had about 9 cops watch how this unfolded. They tried to bargain me down to a lesser charge before my court time and I refused and it REALLY pissed off the cops. In the end, I walked out of the court house with 9 cops scratching their heads and a clean license.

Again, it's a LOT of shit to prepare, but technically you can use it to get out of paying taxes, credit cards, clean your credit record, and other more practical shit too. However, if applying for ANY gov't related position, including military, etc.. you will be denied if they discover you have done this. You are literally severing yourself from the indebtedness of the nation by severing surityship of any debt of this country you are unwillingly born into when your parents unknowingly sign your birth certificate and a SS # is assigned to with an ALL CAPS NAME making you an entity of business in this country. Have you ever, I mean EVER, gotten any financial anything, be it credit card, bank, court notice, child support, employer doc. etc. that DID NOT show your names in ALL CAPS ?? There is a reason for that. And it's frankly a pretty scary one.

EXACTLY. What I'm referring to are the French-Normal laws that were placed in your country by William the Conqueror after the Battle of Hastings in 1066. They were passed onto the U.S. during the Battle of 1812 when the British burned the capital and instilled their banking system and other laws along with it. Some cat in the US got like 4.5m in a suit using his copyright.

The reality of it is, a battle to get that much would be long as hell and go on and on and on. The goal in me doing this is to get out of shitty situations that have nothing to do with justice. There have been times where I did not use it because it simply was not worth all the hassle.

As I understand it, only about 5000 people in the U.S. have done this (as of 1999). The broad principle is valid: keep your mouth shut. More people have been sunk by trying to explain themselves than you can imagine. Many beatable cases have resulted in convictions that could have been beaten if only the person had shut up.

There may be a possible exception for this when dealing with minor issues like traffic infractions and petty misdemeanors like that. But the problem is that it's often not possible to know is something will stay "minor" or escalate into something more serious.

Maybe the best rule is: if you have any doubt at all about saying anything, say nothing.

Jesus Christ, no. What most likely happened to you is the cops figured you were going to be such a hassle they didn't care enough to deal with the paperwork.
