A Manhattan Supreme Court justice grants a woman permission to serve her elusive husband divorce papers via private Facebook message. Is this a sign of what's to come?

A judge has granted a Brooklyn woman permission to serve her husband divorce papers via Facebook, but it's unclear if the decision will set a legal precedent for others who'd rather divorce the digital way.

On March 27, Manhattan Supreme Court Justice Matthew Cooper granted 26-year-old Ellanora Baidoo permission to serve her husband divorce papers via a Facebook private message after attempts to contact him proved unsuccessful.

This isn't the first time a US judge has granted someone permission to serve legal documentation on Facebook -- last year, one man was allowed to serve legal documents related to child support payments on the social network. The practice is more common outside the US, however, and some countries even permit divorce via text message.

Spinnell will now send Blood-Dzraku one message per week for either three weeks or until Blood-Dzraku acknowledges receiving the message, according to the court filing. The filing adds that Blood-Dzraku has proven difficult to find because he doesn't have a job, a driver's license or even a fixed address. The last address Baidoo has for him is an apartment he vacated in 2011, but the couple has kept in touch via phone and social media, though Blood-Dzraku has refused to appear in person to be served the official divorce paperwork.


Facebook declined to comment on the case.

While it's unclear whether the decision involving Ellanora Baidoo could be used as precedent for other cases, the case certainly raises provocative questions. As requests for electronic legal notices continue to rise, could your next major life change soon be just an email or Facebook message away?
Baidoo and Victor Sena Blood-Dzraku were married in a civil ceremony in 2009, but the relationship fell apart quickly once Blood-Dzraku reneged on his promise of a formal Ghanaian wedding, and the couple never lived together, Baidoo's lawyer, Andrew Spinnell, told the New York Daily News. Both Baidoo and Blood-Dzraku are from Ghana, and Baidoo wanted her family to be present for a formal wedding, her lawyer says.

It's a sign of the times gents. I still find it far more interesting that social media content is used as a means to charge and convict people of crime, and that shit has been happening for years now.

This is interesting. Isn't the problem actually verifying that the facebook account is indeed Mr Blood and not an impostor? If I created a facebook account under his name and then sent this woman threatening messages could Mr Blood be arrested for rape because his facebook account "must be him".

I knew this shit was coming the day I quit Facebook in 2011. And it will not stop with this, either. The powers that be will want to monitor people in real-time. That's the nature of female judges. It's not enough to tear a man down. They want to regulate and monitor him 24/7.

Ditch ALL social media while you still have the freedom to do so. Or use Tor for a fake Facebook account.

Would this not require a straight up un-friending though? I mean, if you just unfollow someone on FB you are not subjected anymore to their online inner monologue but you would still get a PM from the unfollowed friend.

If you block someone, they cannot see your profile at all. Combine this with messages from friends only, no public page, and you shouldn't get unwanted messages.

When I read the title, all I could think was, "do I really need another reason not to have Facebook?"

This is a lot less ridiculous than it sounds.

When you sue somebody, you have to serve them notice they've been sued. Wife has undoubtedly attempted many times to serve Husband through the proper channels before seeking a specific court order to use Facebook. He's intentionally ducking service. Her other option, in a lot of cases, is to serve him "by publication" by printing it in a newspaper. At least the Facebook method is geared toward direct contact.

Also, for those of you freaked out about being tracked or pulled into court through Facebook, service of a complaint doesn't cause that to happen. Personal jurisdiction is an entirely different issue.
