Man spends £200k to prosecute a false rape accuser who kills herself out of stress
Quote: The father of young woman who told police she was raped but killed herself after she was put on trial accused of making up the ordeal says she was hounded to death.
She had been charged with perverting the course of justice after the man who allegedly attacked her spent £200,000 on bringing a private prosecution.
Police believed the vulnerable A-grade student, who suffered from a psychiatric illness, had told the truth about the rape when she reported it, but decided there was not enough evidence to bring a successful conviction, so closed the case.
But the Crown Prosecution Service put Miss de Freitas, who had bipolar disorder, on trial after the alleged perpetrator spent vast sums of money pursuing the matter.
Now her family are urging the coroner at her inquest, due to begin today, to carry out a wider inquiry into whether the CPS breached her human rights by pressing ahead with the court case.
David de Freitas, the victim's father, told MailOnline today: ‘We can see no reason whatsoever why the CPS pursued Eleanor.
‘If the CPS had put a stop to it at the time I would still have a daughter. She would not be dead. It is as clear as that'.
Mr de Freitas fought back tears when he discovered his daughter killed herself.
He said: 'Stunned and so sad. I just don't know how to describe it.'
The devastated father said the police were absolutely clear they believed her and were worried it would be 'cruel' to put his vulnerable daughter through a rape trial.
In particular she feared being sectioned because of her 'cruel' bipolar, he said.
He said: 'Police believed her but decided not to prosecute because of evidence that was inconsistent. They didn't want Eleanor to have to go on trial herself.
'When the man she alleged raped her took out prosecution against her she was shocked and in dismay. She had been very happy at that time. 'We were utterly amazed and flabbergasted that they decided to continue with the prosecution. It put her in a very low place. (The entitlement here is disgusting.)
'When she got her prosecution summons it was on the morning of a financial exam and she was in such a state of panic she had to leave during the exam.
'Police told her they weren't going to prosecute her but then the CPS said they'd support a private prosecution.
'In the end she couldn't cope with it. It was tragic, tragic, tragic.
'I feel the system of fairness in this country has let me down terribly.'
'Eleanor was a vulnerable young woman who made a complaint of rape as a result of which she herself became the subject of legal proceedings.
'This was despite the fact the police did not believe there to be a case against her.'
The family's lawyers will argue prosecutors breached Article 2 of the Human Rights Act – the right to life – by failing to consider whether there was a public interest in prosecuting the troubled young woman.
They want a full inquest, with a jury, to consider whether the CPS' decision to take her to court contributed to her death.
Mr de Freitas said: 'We want the truth. I understand why the CPS is carrying out its own investigation but it is too little too late.
'It is rather like inspecting your own naval or getting a doctor to do it. That's the difference here. A full inquest would give us proper answers'.
Victim Support and Justice for Women have contacted her to express concerns about the implications the case may have on people reporting rapes.
Last years violin virtuoso Frances Andrade, who was accused of lying about being abused by her music teacher, killed herself during his trial saying it was like being 'raped again'. Michael Brewer was later found guilty of a string of sexual assaults on her.
Director of Public Prosecutions Alison Saunders, the country's top prosecutor, has pledged to investigate the case personally, saying it was 'one of the most difficult I have seen' and she shared the family's 'unease'.
She said: 'I am very saddened by the tragic death of Eleanor de Freitas.
'I have asked the team which dealt with this case for a full explanation which addresses all of the de Freitas family's concerns.
'I appreciate the family's unease which is why I am looking at this personally in order to satisfy myself of the detail surrounding all the stages of the case.
'Prosecuting cases of perverting the course of justice in connection with an alleged false rape allegation is rare, extremely difficult and always complex and sensitive.
'This case was one of the most difficult I have seen. To say any more at this stage would be inappropriate until I can answer the de Freitas family's concerns fully and directly.'
Campaigners expressed fears victims could be deterred from reporting crimes in future if alleged attackers are able to use the law to intimidate them.
On January 4 last year Miss de Freitas told police she had been drugged and raped by a male associate shortly before Christmas 2012. Detectives arrested the alleged perpetrator. But police eventually told her the gap in time before reporting the alleged rape and the lack of forensic evidence meant there was no realistic chance of a successful conviction.
'One man was arrested but subsequently released with no further action due to lack of evidence, and the case was closed.'
Mr de Freitas said his daughter accepted the police decision and tried to get on with her life.
But the man began a private prosecution, saying she had lied about the rape.

tldr version: Woman falsely accuses a man of raping her but is charged with perverting the course of justice. The guy is pissed and spends £200k on bringing a private prosecution against her. She can't handle the stress and kills herself.
A false accusation cannot just be forgotten. The falsely accused man could just have easily committed suicide. It sickens me how the article is written blaming the guy for wanting to spent vast sums of money to clear his name and how his actions were the cause of her death. The implication of this article, and of "campaigners", is that the young man should not be allowed to protect his own good name. I find this very disturbing indeed.
There's no mention of the false rape claim and the effects this could have had on him. They bring up the fact that she is 'bipolar' and has 'psychiatric' issues but that's neither relevant nor helping them in anyway. Where was this condition when she was making this claim?
If you make false rape allegations then you have to be prepared to take the consequences, the men who are accused certainly have to. Good on the man for spending so much money to clear his name and prosecuting the false rape accuser. If only more men did this then false rape accusers would think twice before trying to ruin the life of a man. Even if the man is found to be innocent his name is dragged through the mud and the damage is done already. I say again good on the man. I hope this story paves the way for other men in the future who are falsely accused of rape to follow suit.

Yeah the alleged mental illness makes this a messy case, but you immediately see the 'side with the woman' slant (although this is the UK, which is even more Left than the US).
If the CPS took it up, there must have been good evidence. She then decided to kill herself before the trial. Together, those things look suspiciously like 'she did wrong', and that the man she accused had a fair case. Otherwise, why didn't she just go to trial?
But the article frames it all like she was the victim, focusing on her fathers sorrow and women's rights groups. Pretty disgusting really.
If she tried to have someone falsely convicted of rape, is the accused supposed to just sit back and take it, lest she kills herself? Wow. Does anyone know the difference between right and wrong anymore...

It's interesting how this woman is known by everyone to be bipolar, and no one interviewed considers the possibility that a man spending $200K to clear his name, even after being acquitted, might indicate her condition was the problem and she was lying about rape. I understand the family members taking her side, as they are in an emotional state and admitting that she may have lied can feel like betrayal. But the fact that the reporter doesn't bother interviewing anyone on the other side of the fence, or most importantly, the accused, is pretty revealing. Talk about being in denial.

We need a huge paradigm shift so that those accused of false rape are protected in the same way that false rape accusers are protected....WITHOUT spending 1/5 million dollars to do so.

I guarantee you, she would never argue that rape prosecutions should only be brought where there is overwhelming evidence against the accused.

That man lost 200k just because the system he pays into has no interest in his well being.
We watched a documentary in my abnormal psychology class on mental patients, and the bipolar and borderline personality women in the documentary overwhelmingly reported staff as having raped them. Of course the staff had to do a full assessment of EVERY single claim, but then when evidence came to light (or psychiatrists were convinced these women were lying) that they were wrong, they recanted their statement usually by saying "I don't remember saying that."
Obviously these women's circumstances are different, but I do believe that it takes a certain type of woman to falsely accuse someone of rape. In my experience all of my past female friends who used to make ridiculous claims that men raped them would have fallen into the borderline personality spectrums and narcissistic personality spectrums. My female friend who I am convinced had borderline personality, the man she claim that raped her did not even exist, and when confronted she just said "I was talking about someone else."

I have no doubt that these people have an agenda and that they are interested in spreading it, but that leaves out what I think is the most important factor: people want to consume stories like this. Nike is a big company because people want their shoes; Obscure Shoe Company is not because nobody wants to buy their shoes. Likewise, the people who succeed in news are the people who supply what people want. Most of the complete bullshit journalism (like the obvious bias here) is consumed by women. The less obviously biased and/or frivolous the news outlet, the more it serves a male readership, e.g. Financial Times.
