It will cost you a couple hundred bucks to consult with a lawyer. Why not do that and get a sense of what the laws are in "her" state.

You could always ride it out, play nice for a few years make cash at your job while off-shoring money and making and escape plan.

If you bolt now and she goes to court you lose your passport, if you bolt in 3 years you lose your passport, but with some extra cash for yourself. So it probably doesn't hurt to hang around for a few years and see how it goes.

I'm really not looking to run away, but was actually planning a major move abroad in the not too distant future. She knew this too. I just want no part of babies like this. Not like this. Not with her.
I want to crawl into a hole and not come out for a while. But if the payment is reasonable and not more then like $2.5k a month max, I will take my lumps and still stack a little more paper and leave when I was going to.

I thought about this...But the 38 years old bit baby rabbies and her incessant questioning about how I never planned to stay with her made it a hard one to execute, you would have to jump on this plan the moment she mentioned 'pregnant' in order to have any chance of success.

While I felt hurt for a few seconds do to a feeling of guilt. I am over it already. At the end of the day, if I tried to 'hang in there' because its the martyr's way, I would have been very miserble and resented them both immediately and always for having my wings clipped when I didn't want them to be. Then, after a couple years of co-habitating, which would also have been horrible, I would have been forced into the commonlaw swindle which is as bad as a divorce in the courts eyes, and been raped. I think I was just used as a sperm donor..

It depends on the state. In New York emancipation is 21 and they don't necessarily have to go to college. They just have to be "dependent" enough to find more money useful to have in their lives.

In NJ it's 18, but I believe that's a guideline and not a hard number like NY has with 21. Under certain circumstances, in NJ it could go beyond 18 with no set end date, at least that was what I interpreted from reading the law, but I've only had to deal directly with NY so I can only attest with certainty to that state.

In the end, the judge decides what will happen and judges don't like people telling them what the law is. They want to be the law, so they often just do what they want. You could appeal, but it will cost a lot in lawyers fees and you may be forced to pay for her lawyers too.
