Wow! I can't even believe this is legal. Here's what happened to this former Tax Lawyer:

- Wife took everything this Lawyer has (house, money, assets)
- He's banned from seeing his kids
- He had to pay 100% of pre-Tax income to Wife. Man had to pay for his taxes, food and housing and went broke.
- He loses license to practice Law once he was unable to pay his Child Support.
- He is now in jail in Colorado.

The present dispute raises the issue whether an obligor spouse’s retirement funds in a plan subject to the Employee Retirement Income Security Act (ERISA), 29 U.S.C. §§ 1001-1461 (2010), are exempt from assignment under a qualified domestic relations order (QDRO) to satisfy domestic support arrearages. Husband argues that his retirement funds are exempt under both Colorado and federal law. We hold that the funds are not exempt, and we affirm the trial court’s orders for a QDRO assigning the funds to wife, and sanctioning husband for noncompliance with the transfer."

"The parties’ marriage ended in 2010 and husband was ordered to pay wife $5000 per month in child support and maintenance of $12,000 per month for four years, followed by $8000 per month for two years."

So the full story seems to be he was ordered to pay an excessive amount due to the large amount of retirement funds he had, which the judge ordered should be split evenly. Because he refused to hand over those funds, he was unable to pay the child support with only his current salary. Thus he got behind and went to jail. His claim is that based on current law he should not have to legally hand over any of his retirement funds.

If one does decide to marry I think having some secret foreign assets like property or precious metals in a safety deposit box somewhere would be a good idea in case you need to dip. Something that the US government can't get their hands on isn't currently reportable. I'd also keep this info from the wife if possible.

I don't know why the spousal support and alimony were so high. But I'm sure there are many deadbeat dads who hide income. They usually cough up the money when faced with prison. So judges must threaten prison in many cases.

All the more reason why men with assets need to open an off-shore account, under an alias...HA HA! At the end women are vicious - they'd rather get nothing and see you in jail than to come to an arrangement that allows him to work and live while also contributing to the support of his children, and to the support of a hateful bitch.

Probably plenty of good dads who hide income as well. There is no reason for a woman to get such ridiculous amounts of money from her ex husband. Half of them will spend it on booze and shit anyway while the dad is still stuck buying necessities for the children.

As I said, it seems the alimony was so high because they factored in the husbands net worth including the retirement funds. I don't think they could ever assign 100% of the husbands salary without doing that.

I thought slavery was abolished with the 13th admendment of the Constitution in 1865?

This guy is 100% at the mercy of his wife/family courts and is now legally the property of the state. To me prision should be reserved for people who cant function in society and present a risk to the general public. That is what it should take for a citizen to be stripped of all their freedoms and removed and locked up away from society. So when a respectable citizen (uppper middle class) can lose it all (career, freedom, reputation) just because he decides to divorce all this does is put the fear of god into other men about what can go wrong in the event of divorce.

Think about this concept for a minute. Debtors Prison. This is where they would stuff you if you wouldn't or couldn't pay off a debt. The pretext is failure to pay child support. But if you're incarcerated and you're stripped of the means of working how can you possibly pay? The answer is simple, you can't. These laws, like most laws are not there for the betterment or safety of society, they are a means of control. Do as WE say or go to the state controlled Rape Room.

I still get why people who get caught in these situations don't just slaves. If they're going to make you a slave to your ex-wife- slavery is not a new thing here, but why not at least try running away from massa?

He could go work under the table for cash in some boomtown in North Dakota. He could walk across the Mexican border and teach English. Hell, he could use American status to run drugs. But at least try making a run and living in a freedom.

Does anyone know if this guy entered into some kind of agreement to pay those amounts of alimony and child support or if a trial was held, after which he was ordered to pay those amounts? More often than not when I see people who are ordered to pay such ridiculous amounts, they agree to pay those amounts in some type of separation agreement, then down the road, start blaming everyone other than themselves for entering into such agreements. If a judge ordered this after a trial, was there any kind of appeal afterward?

You should read up on Thomas Ball. He set himself on fire (and died) on the steps leading up to the court house on the day of his 'Contempt of Court' hearings. It was the final straw in his ongoing divorce proceedings which had been going on for ten year.

Before his death he sent a 15 page letter to the local press. The story deserved to be worldwide news.

This is a key paragraph from his letter:

Well, I can assure you that everything they do is logical and by the[ir] book. The confusion you have with them is you both are using different sets of books. You are using the old First Set of Books - the Constitution, the general laws or statutes and the court ruling sometime call Common Law. They are using the newer Second Set of Books. That is the collection of the policy, procedures and protocols.”

Wonder if/when we will see an uptick in homicides/accidents? Consider the stakes I'm surprised there isn't an epidemic of sudden death before divorce. 'They took up hanggliding to try and breathe new life into their faltering marriage, unfortunately she didn't hook in one day...'

Exactly. What they do where I practice is find a person in contempt and sentence him to a period of incarceration with what is known as a purge provision. The purge provision allows him to avoid jail as long as he makes some specific amount of payments toward their outstanding debt. If he doesn't comply with the purge provision, the same thing usually keeps happening, whereas there are always purge provisions in the future.

There was a Men's Rights Movement in the UK under the banner of 'Father's 4 Justice'.

I read a book by the founder of the group. The scary thing is that the British Security Services infiltrated the group and started to plant stories in the media about 'Father's 4 Justice' planning on kidnapping the Prime Minister's baby (for a few hours).

After the outcry the group disbanded. It is shocking that the secret services should be used in such a partisan way. Yet - it is also revealing how scared the political elites are of men coming together and protesting.

Also - it was sad because the people running the group were suspicious of the new members from the beginning - and straight away thought they had links to either the police or the intelligence services. Particularly since they were deliberately trying to push for the use of violence and so on when planning future stunts.

Anyway - here is the greatest stunt they had [watch from the 1:20 mins mark]:





The key thing to remember about children is this.

If your wife/girlfriend makes an allegation of domestic violence against you. You will be arrested and forcibly removed from the home - that very same day. And you will have to have supervised visits with your children until those allegations have been dealt with by the courts. This can take years. And once an allegation has being made it is virtually impossible to get such an allegation withdrawn - even by the person making it.

And on top of that - any new partner can see as much of your kids as they want. So - you will often have situations where the new father figure (who has no biological links to the child) will have 10-20 times more access to the kid than the real father. My brother recently had a kid and I often remind him how fucked up that is. In theory I could shack up with his partner, see as much of his kid as I want and then ring the police and have him arrested every time he came round for an unarranged visit to see his child.

And you face prison if you don't keep up with alimony payments. But that seems to be (as far as I can tell) a bigger problem in the US than the UK. I am not sure what the state of alimony is in the UK compared to the US. And even in the US it varies state by state (with California being one of the worse).
