Not being a white knight and we don't know the facts for sure, but presuming that the dude got hard and wasn't incapable of resisting, does it mean that he's consenting?

I can actually see some sense in this.

How would you feel if you were roused from your sleep by a blow-job, opened your eyes, and looked down to find some swamp-donkey sloshing away on your bat?

And what if she was doing this to cockblock you with some other woman?

Also, who knows what STDs she might have.

I'd be pissed. And think about it like this, if you try to physically subdue her, she might claim that you raped HER. And, I'd bet there's a good chance that she'd get away with it.

I have mixed feelings about this. Banging a passed-out chick is pretty damn grimy and odds are it's rape if she's twice refused you before passing out. That being said, our criminal justice system is based on the presumption of innocence, so the prosecution should have to actually prove its case and not just get a conviction by asserting what might have happened.

Whether one condones this woman's behavior or not, that this is a legal matter at all is an entirely predictable outcome of the explosion of ridiculous sex crimes laws over the last few decades. In systemically enacting progressively broad and restrictive laws that were intended to target male sexuality while claiming to be gender neutral, it was a foregone conclusion that some woman's ox would eventually get gored.

Expect to see more of this.
