Also when she says she's going to get an attorney does that mean her insurance company will assign her one for free or will she go out and find one herself? Aren't attorneys super expensive?

She will get an attorney who will work on a contingency basis. He will likely review her medical docs before taking her on as a client. Then he will make a demand directly to your insurance company. If needed, your company will provide you with a lawyer (either in-house or from panel counsel).

Slightly off topic, but why is it in the US that you only have minimum insurance limits of like 25/50k or so? When I lived down there, that's what I got since they said me not owning a house meant that they couldn't go after me for anything, and that was the legal minimum. In Canada I think it's like 500k-2 million required insurance.

It just seems odd, because 50k or whatever in the case of an extremely rare big accident is nothing, and as I recall here the cost to increase from 500k (legal min) to 2m, was very little, presumably because there are so few accidents in that range. So for marginal savings to the consumers, unlucky people get fucked financially on top of getting run over or whatever?

Honestly so many people out there driving with the legal minimum is basically the same as driving without insurance. Financially, a $25K hit would suck, but it's hardly life ruining compared to say 800k worth of life time medical support which 99% of people simply can't deal with.

$2500 on a single scratch? She probably got a body shop to make a huge quote too and wants to pocket the claim without actually having the repair done. I've had my rear bumper and trunk lid completely smashed in a collision, and the roof of my car caved in by a tree falling on it. Both of those only ended up being like 3-4 grand in repairs.

That $2500 estimate sounds too high based off the incident: Last Thanksgiving, a guy reversed into my car at a red light. To replace my fender, paint(to blend), and labor was about $1200.

I had the same accident years ago when I started driving! The car in front of the car that was behind moved bit they didn't. The best advise I was given was think as every driver on the road as incapable of driving.

This sounds like a situation where an event data recorder would be useful. I was going to get one, but when it comes time to use the data in court, they have to use your data prior to the event as evidence. So it could show haow I was going 123 in a 35 the day prior. Slippery slope.

Why should I proactively be going out seeking a lawyer for such a simple case? Shouldnt my insurance company deal with it if and when I get the demand letter? They should have hundreds of lawyers on their payrolls.

Kona's messing with you. You don't need a lawyer.

You will get a subpoena that explains exactly what day and time you need to show up if that happens. Show up and retell the story. That's it.

And for that ticket: you have a few options.

1. Pay it (you might get points on your license assessed if this happens)
2. Contest it.

If you live in a state where the ticket wouldn't add points to your license then I would just pay it and move on.

If you do, go to court and explain why you think you weren't going too fast. Ideally, the state just wants money and you might be able to negotiate away the points but still pay the fine.

It's up to you depending on how valuable your time is.
