Student Wrongfully Expelled for Rape Triumphs in Court: Due Process Beats 'Yes Means Yes'

A judge overturned the expulsion of Corey Mock—a University of Tennessee at Chattanooga student and star wrestler—after determining that UT’s administration had improperly required Mock to prove that he was innocent of sexually assaulting another student.

The decision is a significant blow to the concept of affirmative consent. According to Judge Carol McCoy, UT’s consent standard wrongfully shifted the burden of proof and violated Mock’s due process rights.

So many reasons to find this interesting.

So a student's constitutional rights say one thing: that he is entitled to due process before an agent of the state can shut down his academic career (I happen to agree with this wholeheartedly by the way), and the Obama Administration says another: that Title IX funding is linked to shuttering due process.

What's a state school to do?

In the end, they will always choose money over individual rights. They are not going to give up their access to big daddy government's wallet. They can;t afford to. The schools will reason that not every individual (read: male student) who gets rail-roaded by the reverse onus will have the time, resources and ability to sue. Sadly, that supposition would likely be correct.

Just a human enjoying his "Apex-Predator Privilege" atop the food chain.

It might be a little bit easier for other students now that there is legal precedent.

SJWs typically push someone into a lawsuit (like that gay couple suing a baker for not wanting to provide for their wedding) so that they have a legal precedent to launch a Blitzkrieg from. The case above may work to make new cases easier and cheaper.

Well, it's going to cost the state a lot more money if they have to payout millions to every student they deny due process towards.

Fact is, most lawyers will work for free on these cases with the proviso of taking 30% of the winnings or something like that. Schools have the deepest pockets of them all.

I already see the lawyers smelling blood in the water after this case.

The hardest hit victims of the yes means yes policy are not simply men but specifically men who can't afford to lawyer up with daddy paying all the bills. How many college kids have been kicked out unfairly due to this policy and not been able to challenge it before Corey Mock came around and took it to court? I can name 1 close friend from my own experience. Fucking disgusting and even though you'll find all kinds of college-aged men fall victim to these policies, it more drastically affects those who can't battle in court due to a lack of funds.

The Judge Advocate found my son “not responsible”. Two weeks later, with no additional evidence or fact findings, the Judge Advocate reversed her decision. A State Appeals Court Judge recently overturned that decision a year later and my son is now a student “in good standing”. Also, this is another loss for Anna Merlan, who if you remember, tried to shit on Richard Bradley for saying that the UVA case was a hoax. She then had to backtrack. Here, she wrote a chest thumping piece at Jezebel earlier this year criticizing Mock's father for starting a blog to defend his son.

Positive first step, but a "triumph" would be if UT had to pay a huge settlement and all of the responsible personnel were fired without pensions. Not sure what to do about the girl in question, but there's no way her claims should have been taken this far with no evidence.

All rape claims should be a police matter, the university should only take action once the criminal trial has determined guilt.

Here is another recent case in California where the judge ruled that UC San Diego failed to provide a fair process for the accused. In addition to the lack of due process, the college also added sanctions in order to punish the student for exercising his right to appeal.

Where is the outcry? Where are the people fighting against this injustice?

It seems as though the College people just wash their hands of it. They are just as much a part of the problem as that disgraceful false rape accuser.

I was 30 minutes drive from University California Santa Barbara (UCSB). Fuck college you'll learn more reading at a public library and with an obsessive amount of motivation.
