It's not hypothetical to be willing to jump a criminal. The law and law enforcement is incredibly lenient towards violence against criminals by other citizens. Speaking in black and white law terms - this was assault and the dude would be fucked if charges were pressed.

Speaking in well-reasoned common sense terms - this was innocent fun and the girl is just attention whoring ontop of attention whoring.
