The three were indicted by a grand jury and arraigned for 10 misdemeanor charges, including assault, attempted assault and false reporting, along with a violation for harassment.

The decision to dismiss the students came through a student conduct board, which is separate from the criminal justice system.

A hearing before a student conduct board is scheduled when a student is facing suspension, dismissal, removal from residence or at the discretion of an administrator.

The three did not appear for their scheduled student conduct board hearing March 9, as their lawyers cited a conflict of interest in which UAlbany served as judge in the board hearings and witness in the criminal case.

In their absence, only two witnesses spoke at the hearing, according to a confidential letter recapping the hearing.

One witness was Inspector Paul Burlingame of the University Police Department, who cited video, audio, witness interviews, and more than 300 hours of investigation as he testified to the board that the three women started the fight.

"There is absolutely no evidence which supports Ms. Burwell's version of events that the incident was precipitated by a female passenger hitting Ms. Burwell while Ms. Burwell was seated," Burlingame said, "and in fact, there is no video evidence showing Ms. Burwell being struck by anyone at all."

Because the incident was first reported as a hate crime, Burlingame testified that victims of the assault did not come forward at first as they feared for their safety.

Only when they learned there was video of the incident did they reach out, Burlingame said.

Two students withdrew from school due to the incident, Burlingame testified at the hearing.

"One of the female victims," Burlingame said, "withdrew out of concern for her physical safety."

Burlingame said another student withdrew, "having been the target of threats made on social media because of the false reports made by (the women) of his having participated in an alleged hate crime.

In March, the Times Union reported that a student widely reported to have left school after being threatened was never registered at the university this semester.

The only other witness at the hearing was by Joseph Brennan, a UAlbany vice president of communications and marketing, who testified that the school suffered "reputational harm" as a result of the conduct of the three women.

Brennan testified that the women's actions impacted the school's recruiting and created a disruption that exceeded that of "floods, hurricanes, power outages and fatalities" he had encountered in his 25-year career. He said UAlbany has already received notifications from families that they would not send their children to "such a place" and that his office has had to cancel production of a fundraising video and a social media campaign as a result of the three women's actions.

In a letter responding to the women's dismissal, Burwell's lawyer Frederick Brewington said testimony against his client was filled with "Trumpisms."

Brewington said those at the hearing were not given evidence that may have contradicted Burlingame's account, and that his client was unable to defend herself due to the school's conflict of interest.

Brewington also alleged that Burlingame misrepresented the content of his witness interviews, and that "at least one of the interviewed witnesses heard other students confirm that Ms. Burwell and the other ladies were called (a racial epithet)."

Brewington noted Burwell had already withdrawn before she had been given a hearing and then dismissed.

On Jan. 30 about 1 a.m., Briggs, Burwell and Agudio, all of whom are black, boarded a CDTA bus at Quail Street and Western Avenue in Albany and along the way an argument unfolded that they alleged involved racial slurs and quickly turned violent. They claimed one of them was kicked on the floor of the bus. They said bystanders stood around and did nothing.

While questioning Briggs about the bus incident, the judge reminded Briggs that she, Burwell and Agudio called 911 twice to report the alleged attack.

"It was indicated to the 911 operator that the three of you had been jumped on a bus by a group of white males and females, assaulted, punched around the head and body and that this was a racially motivated attack. Is that the substance of the 911 call that was made?"

"Yes," Briggs answered.

Briggs admitted she met with a UAlbany campus investigator, watched videos of the bus ride, knew the report of a racial attack was false and still persisted in claiming it took place.

"You allowed that to become the basis for ongoing investigation and action by the State University Police, the Albany County District Attorney's Office and SUNY authorities, is that correct?" Herrick asked Briggs.

The racially charged allegations led to an on-campus rally, nationwide media attention and a sympathetic tweet from Democratic presidential candidate Hillary Clinton.

On Tuesday, reading from a sheet of paper, Briggs told the judge: "While I felt that the comments directed towards me were offensive, I regret that my actions while confronting the passengers on the bus escalated the situation. I also regret that the role I played in the aftermath that ensued, because I should have done more to correct the narrative and truthfully explain what happened on that bus. I regret attending the (campus) rally and never anticipated the tremendous attention that would be given to this story or the far-reaching effect it would have and am disappointed in myself for not handling things differently."


Little told reporters he hoped his client's apology finalized the incident for her. Briggs wants to put it all behind her, he said.

"She really wanted to do the right thing. I think she did that today," Little said.

On Friday, Burwell and Agudio rejected plea bargains from Chief Assistant District Attorney David Rossi requiring they plead guilty to one count of third-degree falsely reporting an incident, a misdemeanor, and harassment.

The judge, in turn, would have sentenced the women to perform 100 hours community service, any time already served and responsibility for any unpaid, uninsured medical expenses of one of their alleged victims.

Burwell and Agudio face up to two years in jail if convicted of misdemeanor assault, attempted assault, falsely reporting an incident and harassment, a non-criminal violation.

These young women are from well to do, educated families. They are still ghetto. If this is the cream of the crop black culture has no future.

I grew up very poor area and the amount of level headed, extremely bright, good natured people in my neighborhood was surprising high. This was a poor white area, also with some punks who were "in a gang" that robbed people and broke into houses/cars. Where are the reasonable, intelligent people in the black communities? Even among the well to do areas the people seem like idiot, low-lifes.

I'll repeat what I asserted when I started this thread, I think this is more of a woman thing than a black thing. Three entitled, upper-middle-class American princesses didn't like it that some other people stood up to their bullshit, so they used an available mechanism available to try to "win" the argument. It's women refusing to think logically and take responsibility for their actions until forced to do so.

Dozens of outraged well-wishers for Ariel Agudio and Asha Burwell packed a pre-trial hearing Friday in the Albany County Judicial Center to lend support.

Agudio, 20, and Burwell, 21, both of Long Island, face up to two years in jail if convicted of misdemeanor charges.

The crowd of supporters were incredulous as acting Supreme Court Justice Roger McDonough repeatedly sustained objections raised by Chief Assistant District Attorney David Rossi.

The crowd watched closely as the first witness, Albany police officer Tracy Sandoval, testified that when she responded to UAlbany on Jan. 30, the defendants and a third woman, Alexis Briggs, were annoyed the officer took so long to arrive.

Sandoval testified that the women, all of whom are black, told her they were the victims of a bias attack that started after they boarded a CDTA bus at Quail Street and Western Avenue in Albany.

Along the way, they told Sandoval, an argument unfolded when Burwell complained about a woman singing a song later identified as "99 Bottles of Beer on the Wall."

It soon turned ugly.

The women were called the N-word and "whales," Sandoval said they told her.

"They just said everybody on the bus jumped them and they were all white," she testified.

Mark Mishler, the attorney for Agudio, pressed the second witness, Albany police Sgt. Louis Aiossa, on whether he treated Agudio as a criminal when the officer interviewed her Jan. 30.

"She was treated completely as a victim," Aiossa testified. He said, when asked, he could not recall whether Agudio had been read her Miranda rights, which informs suspects they have the right to remain silent and have an attorney.

Frederick Brewington, the attorney for Burwell, later asked Aiossa to repeat the various racial slurs and insults that the students said they were called. The sergeant said the defendants said they were called "loud black girls" and "whale girls" and the N-word and told to "shut the (expletive) up."

Prior to the hearing, protesters — including community members, students and alumni — gathered outside and lined the halls near the courtroom, calling themselves marshals to protect the defendants.

They carried signs reading "Shame on Soares," a reference to District Attorney David Soares.

Albany mounted police waited outside the courthouse as protesters gathered.

Afterward, the group shielded their faces as they left the courthouse.

Initial reports of the racially charged allegations led to an on-campus rally, nationwide media attention and a sympathetic tweet from Hillary Clinton during her campaign to be the Democratic presidential candidate.

In June, Burwell and Agudio rejected plea bargains requiring they plead guilty to one misdemeanor count of falsely reporting an incident and harassment.

Last year, the attack drew national attention after Asha Burwell, a black UAlbany student, took to Twitter on the morning of Jan. 30, 2016, to detail a series of harrowing events she said took place hours earlier: She and her friends, Ariel Agudio and Alexis Briggs, who are also black, got jumped on a bus by a group of white students hurling racial slurs, bystanders watched without helping, and when she and her friends called police, they didn't seem to care.

But was that what really went down?

The district attorney's office doesn't think so, and neither does the university, which expelled Burwell and Agudio and suspended Briggs, who was deemed less culpable.

Witness testimony and surveillance video that captured part of the fight played a big role in the DA's decision to pursue charges. Grainy footage showed a chaotic fight in which the only physical blows came from the women themselves. Supporters of the women, however, point out that the video doesn't capture the full fight and their blows could have been defensive.

The verdict came just after 5 p.m. after eight days of jury selection, trial testimony and deliberations — and 15 months after the fight actually occurred.

Burwell and Agudio were found not guilty of charges they assaulted, attempted to assault and harassed other students on the bus, including a woman who they claim called them "ratchet bitches" and a man who tried to record the fight.

In a surprise move, however, the jury found them guilty of some but not all of the counts of false reporting that they faced — namely, the counts alleging they falsely reported an incident when they called 911 and posted on social media that they had just been the victims of a hate crime.

On the 911 calls, Agudio can be heard saying "I beat up a boy" and "I had three bitches down" before an operator picked up the call. Both women told operators that they had just been jumped on a bus by a group of white people because they were black. Not long after, they took to Twitter to lament the alleged attack.

They were cleared of two false reporting counts, however, that pertained to reports they gave to Albany Police Officer Tracy Sandoval and Police Sgt. Louis Aiossa.

Family members of the defendants cried in relief as the jury returned its "not guilty" verdict, then became grim-faced when the "guilty" charges were read.

Agudio and Burwell, flanked by family, declined to speak to the media after the split verdict. Their attorneys, Mark Mishler and Frederick Brewington, said the partial acquittal should vindicate supporters of the women who "lost heart" over the past 15 months.

"This trial could have been avoided had the district attorney's office acted reasonably from the beginning," said Mishler, Agudio's lawyer. "They've treated this as if it were the crime of the century from the beginning. It's not even a crime in our opinion."

In a statement released after the verdict, District Attorney David Soares argued false reporting creates "immeasurable harm" by casting doubt, cynicism and suspicion on those who report legitimate crimes in the future.

"It also means expending precious law enforcement resources investigating falsehoods instead of helping real victims," he said.

The case was steeped in controversy from the moment it was reported.

Agudio and Burwell called police immediately after leaving the bus on Jan. 30, 2016, to report they had just been jumped by a group of white men and women because of their skin color. The bus driver didn't do anything, they said, and neither did the passengers on the bus, who just watched or recorded the assault on their phones.

But public outrage and sympathy soon turned to anger when video surveillance from the bus was released and appeared to show the opposite: the alleged victims attacking white passengers on the bus.

Agudio and Burwell were expelled. A friend of theirs who was on the bus that night and also reported the alleged crime, Alexis Briggs, was suspended after authorities deemed she played a lesser role in the brawl. She accepted a plea deal in court last summer, and told a judge she "should have done more to correct the narrative and truthfully explain what happened on the bus."

Agudio and Burwell were also offered plea deals, though the charges they faced were harsher. They turned them down.

"From the beginning, the (office) has insisted that any restorative justice resolution must begin with an apology for the harm caused by these young ladies," Soares said. "Only one chose to apologize for falsely representing the incidents and accepted responsibility. We respect the decision of the jury after what was undoubtedly a very difficult case."

The case went to trial April 17, and featured testimony from more than three dozen witnesses, including 18 passengers on the bus that night. Defense lawyers told jurors the women were only acting in self defense when they were seen on camera striking other passengers.

Both women testified that a white passenger on the bus called them "ratchet bitches" while another told Burwell she's "(expletive) ignorant" and to "get a job." Burwell said she also heard the N-word used at least twice as the fight broke out.

Assistant District Attorney David Rossi conceded to the nine white and three black jurors that racial bias may very well have played out on the bus that night, but that video and witness testimony made it clear that the defendants threw the first punch.

The jury seemed to think otherwise.

Defense lawyers suggested on several occasions that the district attorney's office was biased itself, having only pursued charges against their clients while giving a "free pass" to numerous students on the bus who admitted to underage drinking.

"One of the things that's been made very clear," Brewington said, "is that hopefully the dialogue concerning race and implicit bias and how people treat each other when they speak to each other and address each other and the language that you use needs to be carefully evaluated, not only by the University at Albany but by the district attorney's office here in Albany."

ALEXIS BRIGGS pleaded guilty on June 21 to disorderly conduct, a violation. She gave an apology and was sentenced to a conditional discharge after the completion of 100 hours of community service.

After the verdict was read, Justice Roger McDonough granted a request by Rossi that the women be released under probation supervision. Agudio and Burwell, who both live in Long Island, must abide by a 9 p.m. curfew with the exception of work and school.

Sentencing will be June 16. The women each face up to two years in jail, prosecutors said.

I think they were hoping for a full acquittal so they could sue the university for damages or to be reinstated. Now, that's likely off the table. If they want a college education, they'll have to apply to and graduate from a different university, which will likely not accept all their transfer credits from Albany. I'd say that they have been held accountable for lying. If you look at the faces of the two girls in the photos with the newspaper article, they have that stunned look that people get when they realize they didn't get away it.
