Exactly, generally it's not legal in a lot of places to discreetly tape someone, however it can stop the whore or over-zealous prosecutor from going forward and that's the main point. The punishment for illegal recording is less than rape and being on the sex offender list for the rest of your life.

Audio recording may be legal in most jurisdictions. You can ask leading questions like "how many drinks did you have today anyways?" etc without making it sound odd.

I believe there are softwares out there that can compare voices and ascertain % similarities or in this case, whether the audio voice matches that of the accuser beyond a reasonable doubt.
