Good clarification, I believe the answer is no. I should have said "seeking, obtaining, and publishing private information"; I doubt they could have convicted him of identity theft without the last part. And the whole case would probably have been much weaker without the extortion.

Paying someone to "hack" someone's pics did him in.

Well he did the error of charging people for the task of taking down the pics, which is of course extortion. Unless they have new laws intact such a site would be possible, if you would let the person sign a disclosure that her or she has obtained the pics legally. Though it would probably still nip you in the butt for identity theft - doxxing the person effectively.

Personally I don't see much reason for publicly displaying someone's full name and address. If you operate such a site, then do it more or less anonymously. It would be seedy enough as it is and likely legal.
