I found that the song they played is "Stukas im Visier" by Feindflug. Heard it in a lot of industrial/goth clubs. It's good shit.

Sounds more like he's trying to get some easy money. Not beta but either greedy or desperate depending on how well he's doing (if he has waited this long to sue I'd bet he has recently gone broke).
