Why would he admit to that in the first place! Even worse, why would he want to do that!

At the moment I don't foresee woman being tried successfully for the case you outlined. Simply because its more easier to frame it as an action that was not active.

Personally, I think the guy should be charged as is in the case. With that said proving that a woman pretended to take birth control is a much more difficult matter as it's a he says / she says type case. Sure you could show hormonal changes but how could you show she actually said she'd take it. (assuming you don't have documented proof)...even then I don't see the case outlined above being tried successfully against a woman.
