Thumbs Up Why is it that women win most child custody cases?
My friend just lost a child custody case. He has a solid income, it's a steady job, good dude.

She works at a retail store making right an hour.

Why does she win? What's the law behind it?

Because the law believes first and foremost that a child needs its mother and that the mother in question will use her (assumed) maternal instincts/good judgement to look after the said child.

As we know, this is a bad idea in a lot of cases because the mothers in question are exactly that, questionable.

I've been in and out of Family Court quite a bit and I can tell you from my experience that this country is under the sway of the Feminine in general, so the Mother usually wins all matters.

That being said, I do believe that a child needs their Mother more than their Father in the younger years. The child needs both obviously, but for the younger years the Mother is more important. As the child get older into adolescence/early teens the Mother is normally rejected for the Father and he becomes more important.

Truthfully, the custody should be shared 50/50 from the get go. One reason it's not is to give a justification for the wealth transfer of Men's assets to Women. This is a real crime, and as in any crime follow the money trail.

It's also a crime that Father's who were married and saw their child every day now only get to see them 4-5 days a month at best.

EDIT: My advice to him would be to always stay out of Family Court. The odds of anything going in his favor is remote and it will cost him in lawyers fees, psychological energy and escalates the war with her. Hopefully she will find a new man and get married, because that should bring a lot of heat off of him.

Most important thing he can do is not engage her. Be business like and never give in to emotion. Keep the exchanges very short and sweet.

It's called The Tender Years Doctrine
