The homeowner seems to have a good argument for suppressing the "evidence". If ever there was an illegal search and seizure, this is it.

I don't see how the prosecution could use this sort of illegally seized evidence.

I didn't realize when I first posted, but it looks like this was in Spain. I wonder how different the laws are.

This is no evidence that there was a search and seizure. The argument could be made very easily that the individual who turned it in came across it through other means.

Also, if this had occurred in the USA, I think that the Constitutional protection against unreasonable search and seizure only applies to agents of the government, although I'm not 100% sure on the interpretation of that part of the Constitution. Honestly, this isn't a scenario that came up in the Constitutional Law class.

He gets cool points for that. But the lowest form of life in any western prison are pedophiles, so it's no surprise that a burglar would turn him in.

Everyone I know who burglarized homes, and I know quite a few, did it because they are fucking idiots. Had nothing to do with being poor or actually needing the shit.

Wouldn't be surprised if it was a victim seeking some revenge without wanting to put his name in the spotlight. Seems like a random thief would have just tossed the video tapes without watching them.
