The judge ruled the activity likely violates the 4th Amendment "Illegal Search & Seizure," but stayed his injunction pending the government's appeal to a higher court.


My 2 cents:

When the news came out about the NSA program, I was not surprised at all. I don't know how anyone could be surprised about what the government is/was doing. I almost exclusively favor taking power away from the government and vesting it in the individual. The government's main argument in this case is that the collection of data is not a search because there is no reasonable expectation of privacy when you use your telephone, especially your cell phone. I can't believe I am saying this, but I actually agree. Ever since I saw those Chris Hansen "To catch a predator" shows (Which was the most entertaining thing on television in the last 10 years), I just assumed I could be being watched if I was doing something wrong. There is a reason I...or you, haven't typed "How to make a B**b" into google...ever. Let's face it. If we didn't expect anyone was watching, this is the kind of shit a lot of us would be looking into for fun.

We probably all agree the government's activity is wrong, but how do you think it will play out legally? This is clearly going up to the Supreme Court.
