Need members help determining car accident
I need the Roosh V members help. Just got off the phone with my car insurance and bitch on the phone says she doesnt see my point of view

I got into an accident and got a ticket for being left of center. I drew in mspaint a quick mock up. Pic 1 is how the street is, Pic 2 is what the cop thinks what happened which is why he give me the ticket

My court date is next week and I was going to fight it but now I have doubt when my own insurance company says I dont have a good case

Here is my main argument. My car has 2 impact points. One in front and one in rear, His only has one which is in front. If I was left of center meaning in his lane I would only have my front side damage. The fact that I have two impacts means my car was at an angel facing inwords
I have attached 3 pics. 1 pic is the other drivers front, other 2 pics are my front and my rear.

I truely think I was not at fault but if the majority of people think I am then I will see if cop isnt present and do not guilty, but if he is I will just say guilty and get on with my day.

Quit yer whining. Looks to me like you were in the other guys lane and pulling back into your lane when you got hit.

OP, unfortunately, by your drawing, it looks as if you were across the center line (probably why you got a ticket). You are going to have a difficult time explaining that. I can see why the insurance is hesitant to side with you. I wish you luck, however.

I get where you're coming from, but he's pretty clearly at fault. I'm as anti-authoritarian as they come and if there was any way to get him out of this I'd be the first to lend a hand but...

When an insurance company says you're at fault, that means the company has to pay for the other drivers' damages and personal injuries (when applicable).

It's in the insurance company's best interest to find a way to absolve you of responsibility and to blame the other driver.

If your own insurance company isn't on your side, that might be a good time to recognize that perhaps you are being a bit emotional about things.

You should still fight the ticket. Guilty or not, put up a fight. That's why courts exist and why you pay taxes to keep the courthouse doors open.

But don't be too emotionally vested in the outcome since it appears you are in the wrong.

Mike CF is 100% right. I'm no claims adjuster but from the diagram, it's pretty obvious that you were in his lane.

My advice? Delay, delay, delay. Motion for continuance, get a new date. Holidays are coming up: Officer may have vacation so they'll push it back even further. Tell them the first date they give you is not good b/c a relative died of cancer out of the country. Postpone again b/c you need to find counsel, be creative.

Look for any errors on your ticket, it's your only chance. I blew a red light in front of cop, got it tossed out in district that has a 65% conviction rate on a technicality.

Here are my thoughts. The police have exactly zero first-hand knowledge as to what happened here. If they do show up in court, which is a big if, I would object to everything and anything that they try to say. It is all hearsay and should therefore be inadmissible in court. In order for you to be found guilty, the driver of the other vehicle must show up in court and prove that you failed to drive right of center. It appears that you are being charged with failure to drive right of center, or the equivalent of that charge, and are not being charged with negligent driving or reckless driving. If that is the case, the driver of the other vehicle need only prove that you went out of your lane. Whether or not you were at fault in the accident is a non-issue. If you failed to stay in your lane and the driver of the other vehicle testifies as such, no other proof is really necessary. If it is your position that you stayed in your lane, you can plead not guilty and testify in your own defense. If you are found guilty after a trial, you can present mitigating information such as clean driving record, lack of history of accidents, the need to keep a clean driving record for school/work/insurance purposes. If you do that, you may be able to get a disposition which does not involve any points being assessed against your license.

The reason why I asked whether your insurance paid for the damages to the other vehicle is that in my experience, the driver of the other vehicle is much less likely to appear as a witness in court if the damages to his or her vehicle have been paid by insurance before court. It appears that the testimony of the driver of the other vehicle is necessary to prove the case against you.
