You know why this "fairness" is total bullshit?

Because online retailers already pay a tax in the form of shipping costs. I expect to see this tax bill passed before Christmas.

You may want to stock up on whatever online goods you can before this is passed.

Looks like Amazon was a big proponent of this bill too. They probably gave all the Senators a few years of Amazon Prime so they could save on their Free Super Shipper Saver discounts.

No surprise that Amazon is supporting this bill. Now that they've got online retailing corned, they'll use taxes to crush their competitors.

Amazon recently has been expanding to many states. Starting in July, we here in Jersey are going to start paying sales tax through them cause they're building a warehouse in state.

Well to be fair, technically you were supposed to report any sales tax from internet purchases in your annual tax return. This measure just makes sure the duty is on the retailers to do so.

California has been begging for this for years, mostly because a lot of retailers avoid keeping stock up within the state to avoid the inventory tax.

Amazon has also been getting bent over by several states because of their use of affiliates. It will get to the point where states will be trying anything to get a cut of sales taxes so this law will make things simpler.

Which is one of the reasons Amazon is backing it.

For me, I am taking my company overseas since I don't deal with physical goods.

For the record, I dislike most politicians. I am Moderate. I think I read that this was a bipartisan bill, that's why I pointed out the Republicans shit talking about no new taxes. Personally, I would want a balanced budget so new taxes, closing loopholes, total tax reform, major cut back on spending to include military, and Medicare reform. All of course is a pipedream except for the new taxes of course.

Shipping costs are not government-mandated revenues, they are just a line-item broken out as fraction of the price of a having a product delivered to your house. Brick and mortar stores could break out the "shipping cost" to have the product delivered to the store - would that magically make it a "tax". There is no justifiable reason for the same product sold to the same consumer to have different sales tax collection responsibilities. Why require one retailer to collect the sales tax while exempting their competitors. Main street stores pay salaries, sponsor little league, etc. Online retailers benefit from roads and educated consumers, so they should have the same collection responsibilities as brick and mortar stores. Lots of businesses (Circuit City, Borders, etc) have died partly because of this unequal treatment.

An idea kicking around in my head should this pass would be to set up a foreign corporation and continue to sell goods to consumers in the US without the sales tax. I'm not sure where the warehouses would be, Tijuana?

Set up two companies. One overseas who takes all orders for products. That company hires your US based company to ship products for the orders you took.

Your US company is a drop ship wholesaler to your overseas company who processes all orders.

What I've discovered at a younger age and promptly became an independent. The actual constituents of the people in congress are big business interests. If you're counting on the people in congress and the government in general to look out for your best interest you are throwing your basket of all your eggs in front of a bus.

False. Brick and mortar businesses pay far less on shipping because they order in bulk. Customers who shop online regularly must pay anywhere from 5-15 dollars more per item to ship their shit.

I actually buy all my clothes in person, because it's cheaper that way, EVEN WITH the sales tax I have to pay in non-online stores.

Online retailers also pay salaries, and although they may not directly benefit their community in any way, still must pay an income and corporate taxes.

The only good thing about this bill is that it would allow states to decide if online retailers should pay a sales tax or not.

Fact is, other than amazon.com - how many online retailers are actually successful? There are tons of small online buisnesses that struggle to make ends meet, and now they have one more challenge to face.

Rather than help raise more tax revenue, I predict this bill will do the opposite as less people in sales tax'd states shop online and instead revert to shopping in person. It will eat at federal income tax revenue that online businesses would normally pay and instead transfer it to state tax revenue from customers who shop in person (and some of who will pay in cash, allowing them to under-report incomes as well).
