That's 100% jail time here in united states.

What if she is awake and says she was sleeping? How does American law look at that? What if you have sex while she is awake and everything then she goes and says that she was never awake but fast asleep?

How does American law view that?

You're fucked because there is no way to prove one way or the other. If she says she was asleep and calls the cops, you will be arrested for rape. Even if you don't get convicted, your mugshot will be plastered in the newspaper and your reputation will be forever tarnished. Not to mention, it could take months before you find out if you are going to be found guilty or not, and there is a very good possibility that you will be found guilty.

Or, the prosecution will threaten you with a severe punishment if you attempt to fight the case, but let you off with a much gentler sentence (as if getting fucked up the ass is ever gentle) if you accept their deal, which may be less than a year sentence, so you serve it in county and not prison, but you will still be registered as a sex offender.
