The bottom line is our society is still largely squeamish about sending chicks to prison, and if we do, it's for lesser sentences than a man would get for the same crime. When Martha Stewart got busted, I loved reading the comments under the articles. Women writing dumb shit like "If she were a man, she wouldn't be going to prison" etc. etc. Really? Federal prisons are full of men for doing what she did, and in fact, I can't think of a story of another woman being sent to prison for insider trading. Wall Street is a man's world, so it's pretty much ONLY men getting busted for these kinds of crimes. Dumb bitches felt like she shouldn't be punished because she was famous and they like her show! The fear that future victims won't report real crimes is a weak rationalization for not punishing this girl. She SHOULD serve the exact amount of time he did, but at least give her a month for every year he did. She needs to know what it feels like to hear those bars close behind her.

I seriously don't know what I would fucking do in that situation. On one hand I would have all of this hate and need for vengeance. On the other hand, I couldn't injure/kill my own daughter, no matter what she did to me.

This is one of the reasons why I focus so hard on making as much money as possible. If you are just some middle class guy, when shit like this happens you won't be able to afford a top notch legal team. You'll get a public defender, or IF YOU ARE LUCKY maybe you can afford some small time defense attorney in private practice.

HOWEVER, if you have money you can put together a "dream team". DNA experts, the leading forensic experts, private investigators to look DEEP into your accuser's and any supposed witnesses lives. Just throw as much money at the problem as possible. Otherwise, you are liable to be completely fucked over.

My only solace in this whole situation is that the bitch who lied on this poor man apparently has a drug addiction problem now and confessed while in recovery. I hope she relapses.

The only judge that many of us may know, judge Judy would have cleaned up this fabricator. No wonder society is crumbling in the west. Preferential treatment for a few while many suffer.

I'm sure he would, that crowd was never good with the law. They are like Jezebel, their idea of "true justice" seem to be a kind of lynch mob.

But even from a layman position it creates a difficult legal situation. She cannot be prosecuted as adult because she did not commit crime as adult, and I don't know how do they try adults in juvenile court and what she could get as a penalty. I'm not even sure if the statute of limitation bars the prosecution. And if she is charged and tried, all the evidence the court would have in this case is her own words, and any defense attorney who passed the bar would give her a proper legal advice on that matter. In short the probability to get her convicted is very close to zero. Obviously the DA thought of all of that, and I'm pretty sure this was the main reason why she decided not to press charges.

I posted this on facebook. I asked women to voice their opinions on the fact that an innocent man got 10 years because his daughter lied... and she didn't get in trouble.

This is a pretty shitty story, but I oldnemesis is right. How do you charge someone for a crime that happened 10 years ago when the perpetrator was 11? I just did a quick search and the statute of limitations on perjury and making false statements are both less than 10 years. Granted, that's what I found with two minutes of googling, so maybe i'm wrong.

All that said, this is pretty infuriating. You have to wonder where the mother was in all this. The story says that the girl admitted to lying way back in '02, but then went back to the story again. It's funny that there seem to be plenty of women out there who turn a blind eye when their husbands or boyfriends are actual child abusers and plenty of women who stand by grade A scumbags. Once she's out of love with you, though, fuggedahboutit... you're on your own.

I've seen the "but she was only 11 at the time" argument but where was this woman when she turned 18, 19, 20, 21, and 22? Remember, she's 23 now.

And even now, this is the reason why she recanted:

"I just want him to be out and freed," Cassandra said in her interview with the police. Then, she said, "I will be free on the inside."

So she can be free on the inside. I doubt she gives a damn that her father has been raped multiple times considering how inmates treat convicts of this nature. Not only was the guy seen as a child rapist, but a daughter rapist as well, which equals guaranteed rape in prison...

I didn't offer any opinion on the girl. I just said that prosecuting her with a crime might be problematic, if not impossible.

The recanting was all make her feel better. Not about someone going to jail on trumped up charge that could've got him raped/killed in the box.

Call me a conspiracy theorist but I believe that the gov't enforces pro-feminist laws b/c they know the true nature of women(fickle, submissive, myopic etc). So they elevate the weaker sex under the veil of "progressive" measures knowing that they won't do jack to challenge the status quo with their newfound "liberation".

Sometimes you have a kid who is just a "Bad Seed". This chick started fucking in the SECOND GRADE. WTF? That is like 7 or 8 years old. Either she has suffered some serious (probably sexual) abuse in her childhood, or she is just a psychopath and/or borderline personality. Part of me suspects a lot of the later and a little of the former.

You take a kid that is already genetically predisposed to mental/personality disorders and have her raised in an unstable household (alcoholic father with a criminal record whose marriage ends in divorce) and the end result is this little drug addicted, sociopathic hell-spawn.

It is not just legal system. Do not forget that he had a jury trial, which means twelve laymen of your peers found him guilty.
